Penalties for minors driving motorbikes according to Decree 168

Ms. Hien Luong (Thanh Vinh Ward) asked: Recently, I see that the Traffic Police force has increased the handling of traffic violations among students, especially the situation of students driving motorbikes to school. I would like to ask, at what age are you allowed to drive a motorbike, and how will those who are not old enough to drive be punished?

Reply:

According to the provisions of the law on road traffic, the age allowed to drive vehicles is determined as follows:
- People under 16 years of age are only allowed to drive bicycles or electric bicycles with pedal assist.
- People aged 16 years and over are allowed to drive motorbikes with a cylinder capacity of less than 50 cm³ or electric motorbikes.
- People aged 18 years or older are granted a driving license to drive motorbikes with a cylinder capacity of 50 cm³ or more.

Regarding penalties, Decree 168/2024/ND-CP clearly stipulates:

- People from 14 to under 16 years old who drive motorbikes, scooters or similar vehicles will be given a warning.

- People from 16 to under 18 years old driving motorbikes with a cylinder capacity of 50 cm³ or more will be fined from 400,000 to 600,000 VND; if driving cars or similar vehicles, the fine will be from 4,000,000 to 6,000,000 VND.

Authorities recommend that parents pay attention and remind their children to comply with the correct age and regulations when driving vehicles, both to ensure their own safety and to avoid breaking the law.
