Previously, at around 1:30 p.m. on November 14, 2015, Dung (then a 12th grade student) and Vu Van Hung (born in 2004, from Mieng village, Phuc Thinh commune) were herding buffaloes at Huong field, Tho Phu village, Kien Tho commune (Ngoc Lac district). At around 2 p.m., Mr. Le Van Tan (born in 1974, residing in Kien Tho commune, Ngoc Lac district) came by motorbike and saw Dung and Hung's two buffaloes eating sugarcane, so he came to take the buffaloes home to deal with them.
Seeing that, Dung immediately ran to Mr. Tan and begged for forgiveness but to no avail. Dung used a sickle to cut the rope to make the buffalo run away. Angry, Mr. Tan used a piece of rope to beat him but Dung restrained him. During the struggle, Mr. Tan fell down. Dung used the rope to strangle Mr. Tan, causing him to lose consciousness. Dung then chased the buffalo back home.
In the afternoon of the same day, some people discovered Mr. Tan lying dead at Huong beach and reported it to the local authorities.
Knowing that Mr. Tan had died, Dung went to the police station to surrender and admitted his crime. At the time of the incident, Dung was under 18 years old and committed the crime while under extreme emotional stress, so the People's Court sentenced Luong Van Dung to 12 months in prison.
