9th grade male student stabbed classmate because of… private conversation
(Baonghean.vn) - Just because of a conflict and argument in class related to a private conversation, a 9th grade male student took a knife and stabbed his friend in the stomach. With the above action, V. was prosecuted and brought to trial for murder.
On the morning of August 28, the People's Court of Nghe An province opened the first instance trial of defendant Luu Quoc V. (15 years old), residing in Thanh Ha commune, Thanh Chuong district, for the crime of "Murder". The victim in the case was V.'s 9th grade classmate - NPH (born 2008).
According to the indictment, at about 9:30 a.m. on December 1, 2022, V. and H.conflictArguing in class, related to V. talking privately and being reminded by H.
The next afternoon, the two met at a shop across from the secondary school gate. There, V. took out a small homemade knife and asked, “Do you want to die?”. H. replied, “Do you want to die?”. Suddenly, V. took the knife and stabbed H. once in the stomach.
Seeing his friend bleeding, V. panicked and ran home, then told his relatives what he had done and asked them to take his friend to the hospital.
The victim was taken to the hospital for emergency treatment and was discharged after a period of treatment. Authorities determined that the victim suffered 55% bodily injury from the injuries.
At the trial, the defendant confessed and admitted to the crime. The defendant stated that he and the victim were classmates and often played together. That day, due to anger and not being able to control his actions, the defendant accidentally stabbed his friend. The defendant expressed remorse for his actions.
The panel of judges determined that the act of stabbing the victim in a vital part of the body, endangering his life, constituted murder and was a crime of hooliganism. The victim survived thanks to timely emergency care.
However, it is also necessary to consider some mitigating circumstances for the defendant such as honestly confessing, repenting, after the incident, influencing the family to pay for medicine, hospital fees, compensating the victim for mental damage of 70 million VND, the victim submitted a petition to reduce the defendant's sentence.
Considering the case comprehensively, the People's Court sentenced Luu Quoc V. to 3 years and 6 months in prison for murder.
