Nghe An province provides guidance on the placement and arrangement of officials and civil servants in merged units.

The guidelines issued by the Nghe An Provincial Party Committee's Organizing Committee aim to concretize Plan No. 285, dated November 18, 2024, of the Provincial Party Standing Committee on implementing Resolution No. 1243, dated October 24, 2024, of the 15th National Assembly Standing Committee on the rearrangement of district and commune-level administrative units in Nghe An province for the period 2023-2025.

On November 20, 2024, the Provincial Party Committee's Organization Department issued Guideline No. 12 on the arrangement of organizational structures, placement, and implementation of policies for cadres, civil servants, public employees, and non-professional personnel in localities implementing the reorganization of district and commune-level administrative units in the 2023-2025 period.

4 general principles

The guidelines set out four general principles for implementing organizational restructuring and assigning, as well as implementing policies for officials, civil servants, and non-professional personnel.

Accordingly, the restructuring of the organizational apparatus and the arrangement of cadres, civil servants, and non-professional personnel in the newly reorganized administrative units must comply with the regulations of the Party Charter, the laws of the State, the Charters of political and social organizations, and the superior agencies and organizations of the vertical sectors.

The arrangement and placement of officials, civil servants, and non-professional personnel in the new administrative unit must ensure compliance with prescribed standards and conditions; the personnel selected for appointment or election to equivalent and higher positions than those before the administrative unit reorganization must have high prestige, outstanding capabilities, and better meet the standards and conditions for appointment and nomination; attention should be paid to experienced personnel with a long history of service, and those with basic training who are capable of meeting immediate and long-term job requirements.

The arrangement of cadres, civil servants, and public employees in the new administrative unit must be linked to the preparation of personnel for the Party congresses at all levels for the 2025-2030 term, and personnel for the positions of Standing Committee of the People's Council, leaders of the People's Committee, and representatives of the People's Council at all levels for the 2026-2031 term.

The arrangement of the number of deputy positions and the number of officials, civil servants, and non-professional personnel must comply with the current regulations of the Central Government and the province for the newly reorganized district and commune-level administrative units.

Guidelines for Party Organizational Structure

The guidelines for merging the Party Committee of Cua Lo town and some grassroots party organizations under the Nghi Loc District Party Committee into the Vinh City Party Committee to form the (new) Vinh City Party Committee were implemented according to the plan of the Provincial Party Committee.

The Provincial Party Committee's Organization Department also provided guidance on how to reorganize Party organizations in commune-level administrative units where other administrative units of the same level are merged while retaining their old names. The procedure involves dissolving the merged commune's Party committee, retaining the old commune's Party committee, and only rearranging personnel.

In administrative units at the commune level that merge to form a new commune-level administrative unit, a new commune-level Party committee will be established corresponding to the reorganized administrative unit, based on the merger of Party organizations of the same level administrative unit before the reorganization.

In cases where a commune needs to be divided into residential areas for merger with other communes, the district Party committee shall decide to dissolve the old commune Party committee before issuing a decision to establish a new commune Party committee and transferring the Party organization in accordance with the regulations of the Central Committee.

In commune-level administrative units that are expanded due to administrative boundary adjustments, the Party organization corresponding to the adjusted boundaries shall be transferred to the Party organization corresponding to the administrative unit after the boundary adjustment, in accordance with the Party Charter.

Regarding the authority of the district, city, or town Party Committee Executive Board, it is decided to establish a new commune-level Party Committee. The authority of the district, city, or town Party Committee Standing Committee is to decide on the transfer of Party organizations and members from the merged commune Party Committee to the new commune Party Committee; to appoint the executive board, standing committee, secretary, and deputy secretary of the new commune; and to nominate and lead the election of the inspection committee, its chairman, vice-chairman, and key leadership positions within the commune under its management.

After being appointed, the Party Committee of the commune proceeds to elect the Inspection Committee and its chairman; the Party Committee's Inspection Committee then elects its vice-chairman in accordance with Article 31 of the Party Charter and Article 22 of the Regulations on Elections within the Party.

The Provincial Party Committee's Organization Department also provided guidance on the naming and term of office of commune-level Party committees after the reorganization of new administrative units; procedures for transferring Party organizations and members; the number of Party committee members, standing committee members, and deputy secretaries of Party committees; the number of members and deputy chairmen of the newly established Party committee's inspection committee; and the process for preparing personnel to participate in the executive committee, standing committee, secretary, deputy secretary of Party committees; chairman of the Party committee's inspection committee and other leadership and management positions under the management of the district-level Party committee's standing committee.

Guidelines for the placement, arrangement, and implementation of policies for officials.

Regarding the arrangement and placement of cadres, civil servants, and public employees: at the time of arrangement, those who reach the age for retirement under the social insurance scheme will have their retirement procedures carried out according to regulations; those who wish to resign (receiving severance benefits under the social insurance scheme) or transfer to other organizations outside the political system will have their wishes fulfilled; those who meet the standards and conditions for other job placement will be assigned to other jobs within the locality, or transferred to another locality for suitable work, or transferred and accepted to work in agencies under the Party, the Fatherland Front and political-social organizations, state agencies, and public service units at the provincial and district levels (if they meet the prescribed conditions).

In cases where officials and civil servants transferred or rotated from the district level to the commune level cannot be reassigned after the merger (even if the required time period has not been met), they may be transferred to work in agencies belonging to the Party, the Fatherland Front and political-social organizations, state agencies, and public service units at the district level.

After the merger, the heads of the Fatherland Front Committee and socio-political organizations no longer have positions available for them to fill, but still meet the qualifications and standards for the job. They may follow the procedures for nomination, election, or appointment to another commune to hold an equivalent position according to the organization's charter, or be accepted and appointed to a civil service position if they meet the qualifications and standards. If the individual volunteers, they may be appointed as deputy heads of the Fatherland Front Committee or other socio-political organizations at the commune level and may be reassigned when conditions permit (if a suitable position becomes available).

In addition to the above arrangements, some senior and deputy-level officials of Party organizations, People's Councils, People's Committees, Fatherland Front Committees, and socio-political organizations... who are still eligible for re-election in the next term but cannot yet be appointed, will be temporarily reassigned to deputy positions; subsequently, depending on the actual situation and the requirements for staffing at the local level, the higher-level Party committees and authorities will consider and appoint suitable officials in accordance with regulations.

For part-time personnel, the number of assigned personnel shall comply with the regulations stipulated in Government Decree No. 33, dated June 10, 2023, on commune-level officials and civil servants, and part-time personnel at the commune, village, and residential group levels.

Guidelines for implementing policies for redundant officials and civil servants.

For redundant officials, civil servants, and public employees resulting from the reorganization of administrative units who wish to resign or retire, if they fall under the category of workforce reduction, the regulations stipulated in Government Decree No. 29 dated June 3, 2023, on workforce reduction and Resolution No. 18 dated October 18, 2024, of the Provincial People's Council shall apply.

Officials who do not meet the age requirements for re-election or reappointment to positions and titles for fixed terms in Party agencies, the Vietnam Fatherland Front, and political and social organizations shall be subject to the provisions of Government Decree No. 26, dated March 9, 2015; Central Organization Committee Guidance No. 27, dated December 20, 2019; and other current regulations.

Officials and civil servants who cease to hold leadership positions or who hold leadership positions with lower position allowances (including those elected and appointed) than before the reorganization of district and commune-level administrative units, but who remain officials and civil servants in agencies, units, and organizations within the political system in the reorganized administrative unit, are entitled to their full salary and allowances, and their position allowances will be retained until the end of their appointed term or the end of the congress term of that organization.

If the remaining term of the election or appointment is less than 6 months, the term will be reserved for a full 6 months. After this period, if assigned to a new position or title, the regulations of the new position or title will apply; if not elected or appointed to a leadership position or title, the employee will receive salary according to their rank, grade, and allowances (if any) or retire according to current regulations.

For part-time community workers who no longer participate in the work, support will be provided in accordance with the provisions of Government Decree No. 29, dated June 3, 2023.
