Nghe An guides the arrangement and assignment of cadres and civil servants in merged units

The guidelines issued by the Organizing Committee of Nghe An Provincial Party Committee are intended to concretize Plan No. 285, dated November 18, 2024 of the Provincial Party Committee Standing Committee on implementing Resolution No. 1243, dated October 24, 2024 of the 15th National Assembly Standing Committee on the arrangement of district and commune-level administrative units of Nghe An province for the period 2023 - 2025.

On November 20, 2024, the Provincial Party Committee's Organizing Committee issued Instruction No. 12 on organizational arrangement, arrangement and implementation of policies for cadres, civil servants, public employees and non-professional workers in localities implementing the arrangement of district and commune-level administrative units in the period 2023 - 2025.

4 general principles

The guidelines set out four general principles in implementing organizational arrangements and policies for cadres, civil servants, and part-time workers.

Accordingly, the implementation of the organizational restructuring, the arrangement of cadres, civil servants and non-professional workers in new administrative units after the arrangement must comply with the provisions of the Party Charter, the State's laws, the Charters of socio-political organizations and the superior vertical agencies and organizations.

The arrangement and assignment of cadres, civil servants, public employees and part-time workers in the new administrative unit must ensure the standards and conditions according to regulations; the source of cadres selected for appointment and election to positions equivalent to and higher than the positions before the administrative unit arrangement must have high prestige, outstanding capacity and better meet the standards and conditions for appointment and nomination; attention should be paid to cadres with a lot of experience, a history of dedication, and cadres with basic training who are capable of meeting the requirements of immediate and long-term tasks.

The arrangement of cadres, civil servants and public employees in new administrative units must be associated with the preparation of personnel for party congresses at all levels for the 2025-2030 term and personnel for the positions of standing members of the People's Council, leaders of the People's Committee, and delegates of the People's Council at all levels for the 2026-2031 term.

The arrangement of the number of deputies and the number of cadres, civil servants, public employees, and non-professional workers shall comply with current regulations of the Central and the province for new district and commune-level administrative units after the arrangement.

Instructions for Party organization arrangement

Instructions on merging the Party Committee of Cua Lo town and a number of grassroots party organizations under the Nghi Loc District Party Committee into the Vinh City Party Committee to establish the Vinh City Party Committee (new) are implemented according to the Project of the Provincial Party Executive Committee.

The Provincial Party Committee's Organizing Committee also guides how to reorganize the Party organization in commune-level administrative units that have merged with administrative units of the same level and still retain the old name. The merged commune's Party Committee will be dissolved, the old commune's Party Committee will be kept intact, and only personnel arrangements will be made.

In commune-level administrative units that merge to form a new commune-level administrative unit, a new commune party committee corresponding to the administrative unit after the arrangement is established on the basis of merging the party organizations of the administrative unit at the same level before the arrangement.

In case a commune must be divided into residential areas to merge with other communes, the district party executive committee shall decide to dissolve the old commune party committee before issuing a decision to establish a new commune party committee and transfer the party organization according to the regulations of the Central Committee.

In commune-level administrative units that are expanded due to administrative boundary adjustment, the Party organization corresponding to the adjusted boundary shall be transferred to the Party organization corresponding to the administrative unit after the boundary adjustment according to the provisions of the Party Charter.

Regarding the authority of the Party Executive Committee of the district, city, and town Party Committee to decide on the establishment of a new commune-level Party Committee. The authority of the Standing Committee of the district, city, and town Party Committee to decide on the transfer of the Party organization and Party members of the merged commune Party Committee to the new commune Party Committee, to decide on the appointment of the Executive Committee, Standing Committee, Secretary, and Deputy Secretary of the new commune, to introduce and lead the election of the Inspection Committee, the Chairman, Deputy Chairman of the Inspection Committee, and key leadership positions of the commune under its management.

After being appointed, the Party Executive Committee of the commune shall elect the Inspection Committee and the Chairman of the Inspection Committee; the Party Inspection Committee shall elect the Vice Chairman of the Inspection Committee according to Article 31 of the Party Charter and Article 22 of the Party Election Regulations.

The Provincial Party Committee's Organizing Committee also provides guidance on the name and term of the commune party committee after the new administrative unit is reorganized; procedures for transferring party organizations and party members; on the number of committee members, standing committee members, deputy secretaries of the committee; the number of committee members and deputy heads of the newly established committee's inspection committee; on the process of preparing personnel to participate in the executive committee, standing committee, secretary, deputy secretary of the committee; head of the party committee's inspection committee and other leadership and management positions under the management of the district-level committee's standing committee.

Guidance on arrangement, organization and implementation of policies for staff

Regarding the arrangement of cadres, civil servants and public employees; at the time of arrangement, those who reach the age of retirement from social insurance will be allowed to retire according to regulations; those who wish to retire (enjoy the retirement regime according to the social insurance regime) or transfer to other organizations outside the political system will be given favorable conditions to fulfill their wishes; those who meet the standards and conditions for other jobs will be assigned other jobs right in the locality, or transferred to another locality for suitable jobs, or transferred and accepted to work at agencies under the Party, Fatherland Front and socio-political organizations, state agencies, public service units at the provincial and district levels (if they meet the prescribed conditions).

In case cadres and civil servants are mobilized and transferred by the district level to the commune level, and cannot continue to be arranged after the merger (including cases where the required time has not been met), they can be mobilized to work at agencies under the Party, Vietnam Fatherland Front and socio-political organizations, state agencies, and public service units at the district level.

The heads of the Fatherland Front Committee and socio-political organizations after the merger no longer have a position to be arranged as heads or equivalent positions, but still meet the conditions and standards for work, then they can follow the steps of the procedure for nomination or appointment to another commune to hold an equivalent position according to the provisions of the Charter of that organization, or be accepted and arranged into civil servants if they meet the conditions and standards. If the individual volunteers, he/she will be arranged to be a deputy of the Fatherland Front Committee or deputy of socio-political organizations at the commune level and will be rearranged when conditions permit (if there is a suitable position).

In addition to the above arrangements, a number of leaders and deputy leaders of Party organizations, People's Councils, People's Committees, Fatherland Front Committees, socio-political organizations... who are old enough to be re-elected for the next term but cannot be arranged yet, will first arrange and assign leaders to deputy levels; then, depending on the actual situation and requirements for arranging the staff and civil servants in the locality, the Party Committee and the superior government will consider and arrange the use of appropriate officials according to regulations.

For non-professional workers, the arrangement is in accordance with the number prescribed in Decree No. 33, dated June 10, 2023 of the Government, regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.

Guidelines for implementing policies for redundant civil servants

For cadres, civil servants and public employees who are redundant due to administrative unit rearrangement and wish to resign or retire, if they are subject to staff streamlining, the provisions of Decree No. 29, dated June 3, 2023 of the Government on staff streamlining and Resolution No. 18, dated October 18, 2024 of the Provincial People's Council shall apply.

Cadres who do not meet the age requirements for re-election or reappointment to positions and titles according to their terms in Party agencies, the Vietnam Fatherland Front, and socio-political organizations shall be subject to Decree No. 26, dated March 9, 2015 of the Government; Instruction No. 27, dated December 20, 2019 of the Central Organizing Committee and current documents as prescribed.

Officials and civil servants who cease to hold leadership positions or hold leadership positions with lower position allowances (including election and appointment) than before the arrangement of district-level and commune-level administrative units but are still officials and civil servants at agencies, units and organizations in the political system in the administrative unit after the arrangement, are entitled to full salary, allowances and reserve position allowances until the end of the term of the appointed position or the end of the term of the congress of that organization.

In case the remaining term of the election or appointment term is less than 6 months, it will be reserved for a full 6 months. After the above term, if assigned to a new position or title, the regulations of the new position or title will be implemented; if not elected or appointed to a leadership position or title, the employee will receive salary according to the salary scale, grade and allowances (if any) or retire according to current regulations.

For part-time workers at the commune level who no longer participate in work, they will be supported according to the provisions of Decree No. 29, dated June 3, 2023 of the Government.
