Nghe An regulates the expenditure level for organizing the implementation of compensation, support, resettlement, and forced land acquisition.

That is the level of expenditure for organizing the implementation of compensation, support, and resettlement; the level of expenditure for organizing the implementation of compulsory land inventory and compulsory land recovery.

On January 20, 2025, the Provincial People's Committee issued Decision No. 05/2025/QD-UBND stipulating the level of expenditure to ensure the organization of compensation and support implementation.Resettlementwhen the State reclaims land in the province.

This Decision applies to units and organizations that perform the tasks of compensation, support and resettlement when the State acquires land according to the provisions of law. Agencies, organizations and individuals related to compensation, support and resettlement; the preparation, approval of estimates, use and settlement of costs to ensure the organization of compensation, support and resettlement when the State acquires land.

Level of expenditure for organizing compensation, support and resettlement

According to the Decision, the expense for organizing meetings with landowners and property owners in the recovery area to disseminate and propagate policies and laws on compensation, support and resettlement when the State recovers land and receives opinions, organizes and mobilizes landowners and related property owners to implement the land recovery decision to implement the project is a maximum of VND 200,000/person/day.

Expenses for investigation, survey, recording of current status, measurement, counting, statistics, classification of land area and determination of origin of land and assets attached to recovered land, including expenses for issuing declaration forms, guiding land owners and property owners to declare, maximum 200,000 VND/person/day.

Expenses for measuring and determining the actual area of ​​land plots within the boundary of the land recovered for project implementation (if any) of each person whose land is recovered as a basis for compensation, support, and resettlement when the State recovers land in case of re-measurement, maximum 200,000 VND/person/day.

Expenses for inventorying the number of houses, structures, crops, livestock and other assets damaged when the State reclaims land from each asset owner are maximum 200,000 VND/person/day.

Check and compare the declaration with the inventory results, determine the extent of damage to each person whose land is recovered, specific property owners; calculate the value of damage to land, houses, structures, crops, livestock and other properties up to a maximum of VND 200,000/person/day.

Establish, appraise, approve and publicize compensation, support and resettlement plans from the stage of calculation and determination of compensation and support levels to the stage of plan approval and public announcement of compensation, support and resettlement plans with a maximum of VND 200,000/person/day.

The organization shall pay compensation, support and resettlement according to the compensation, support and resettlement plan approved by the competent state agency according to regulations, up to a maximum of VND 200,000/person/day.

Expenses for guiding implementation and resolving difficulties in organizing the implementation of compensation, support and resettlement plans approved by competent state agencies according to regulations, up to VND 200,000/person/day.

Expenses for hiring workers to perform compensation, support and resettlement work (if any). The hiring of workers is decided by the head of the unit or organization performing the compensation, support and resettlement tasks, stipulated in the internal spending regulations and can only be done when the unit or organization performing the compensation, support and resettlement tasks does not have enough personnel to perform and cannot perform tasks that overlap with the personnel of the unit or organization performing the compensation, support and resettlement tasks, maximum 300,000 VND/person/day.

Expenses for cadastral measurement of land plots for land plots in places where there is no cadastral map for compensation and site clearance; expenses for renting offices, renting and purchasing machinery and equipment to carry out compensation, support and resettlement work for units and organizations performing compensation tasks and appraisal agencies; expenses for printing, photocopying documents, stationery, communications (post, telephone), gasoline; only for publishing in newspapers and broadcasting on radio or television; other expenses directly related to the organization of compensation, support and resettlement: For expenses that have norms, standards and unit prices prescribed by competent state agencies, they shall be implemented according to current regulations; for expenses that do not have norms, standards and unit prices prescribed by competent state agencies, they shall be implemented according to actual expenditure levels, ensuring savings, efficiency, and having legal invoices and documents.

Level of expenses for organizing the implementation of compulsory land inventory and compulsory land recovery

The cost of informing, propagating and mobilizing subjects to implement the decision on compulsory inventory and compulsory land recovery is up to 200,000 VND/person/day.

Expenses for organizing the enforcement of decisions on compulsory land inventory and compulsory land recovery are up to 200,000 VND/person/day.

The cost of protecting and preventing land re-occupation after the organization carries out compulsory land recovery of the land plot subject to compulsory recovery until the completion of site clearance is a maximum of VND 200,000/person/day.

Expenses for purchasing raw materials, fuel, renting vehicles, protective equipment, medical equipment, fire prevention equipment, other necessary equipment and means for the implementation of compulsory inventory and compulsory land recovery; expenses for sealing, breaking, dismantling, and transporting assets; moving the person subject to enforcement and related persons out of the enforced land area; expenses for renting locations, labor, means of preserving assets and other actual legal expenses directly serving the implementation of asset preservation when implementing compulsory land recovery in cases where the property owner does not pay; expenses for filming and taking photos to serve the implementation of compulsory inventory and compulsory land recovery; other expenses directly related to the organization of compulsory inventory and compulsory land recovery: For expenses that have norms, standards, and unit prices prescribed by competent state agencies, they shall be implemented in accordance with current regulations; For expenses that do not have norms, standards, or unit prices prescribed by competent state agencies, they shall be implemented according to actual expenditure levels, ensuring savings, efficiency, and having legal invoices and documents.

Payment of salaries, salary-based contributions and salary allowances shall comply with the provisions of Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government regulating compensation, support and resettlement when the State acquires land.
