(Baonghean.vn) - To rectify the situation of drivers who are not of legal age and do not have a driver's license when participating in traffic, in addition to propaganda measures, it is necessary to investigate and strictly handle the responsibility of individuals who hand over vehicles to unqualified people.

Driving a motorbike under the legal age

According to statistics from the National Traffic Safety Committee, traffic accidents involving motorbikes and scooters account for about 70% of all accidents each year. In the first 9 months of the year, there were 8,335 traffic accidents nationwide, killing 4,765 people and injuring 5,802. In particular, the number of young people, teenagers, students and pupils violating the law has been on the rise, with 329 pupils and pupils dying in traffic accidents in the first 9 months of the year alone.

In Nghe An, since the beginning of the year, through patrolling and controlling, the authorities have detected and recorded 1,335 cases of students violating traffic order and safety, accounting for 1.9% and fined more than 1 billion VND. In particular, in addition to violations such as not wearing helmets, carrying more than the prescribed number of people... the majority of violations are underage driving.

For example, on the evening of November 11, a group of about 20 young people drove motorbikes at high speed, lined up side by side, weaving and swerving on the road from Nghi Loc district to Vinh city. The incident affected the security and order situation in the area, making people feel insecure. Based on information provided by the people, Police Team 113 under the Department of Administrative Management of Social Order, Provincial Police deployed forces to handle the situation.

At 8:40 p.m., the working group discovered the above-mentioned group of young people gathering at lane 90, Truong Chinh street, in Le Loi ward. The vehicles the subjects drove were motorbikes with a cylinder capacity of over 50 cc, most of them did not wear helmets, the license plates were covered by masks, the vehicles did not have rearview mirrors... When detecting the authorities, some subjects quickly ran away, while 5 subjects and 6 motorbikes were arrested. All 5 subjects were born in 2007 and 2008 (not old enough to drive motorbikes with a cylinder capacity of over 50 cc), residing in Nghi Loc and Vinh city.

Previously, many similar incidents were also handled by the local traffic police, especially in Vinh city. After detecting and handling violations, the authorities sent notices of violations of traffic order and safety to schools to coordinate in educating traffic safety awareness and taking disciplinary action against violators.

Regarding the causes leading to traffic safety violations, according to the assessment of the authorities: The coordination between school - family - society to manage and educate students to comply with the law on traffic order and safety is still ineffective; a number of parents and guardians are still indifferent and irresponsible in managing their children (according to statistics, more than 71% of traffic accidents involving students are due to driving motorbikes over 50cc, this is the result of giving students vehicles to drive in violation of regulations).

Strictly handle vehicle owners' responsibilities

Every year, the Provincial Traffic Safety Committee coordinates with the Provincial Police, the Department of Education and Training, the Provincial Youth Union, and the Traffic Safety Committees of districts, cities, and towns to organize the program "Youth and Children's Day with Traffic Culture", "Traffic Safety for Students Going to School", "Students and Pupils Build a Safe Traffic Culture"..., to promote propaganda and education activities on awareness of compliance with the Road Traffic Law for young people, teenagers, pupils and students. In particular, it mentions a lot about young people driving vehicles when they are not of legal age, not having a driver's license when participating in traffic, increasing traffic accidents.

This is also the content clearly stated in Document No. 8845/UBND-NC dated October 19, 2023 of the People's Committee of Nghe An province on directing the strengthening of preventive solutions; preventing particularly serious traffic accidents. Accordingly, the Provincial People's Committee requires strict handling of violations of traffic safety order by traffic participants using motorbikes, mopeds, electric motorbikes, electric bicycles; in which, focusing on subjects who are young people with violations such as: Driving a vehicle when not of legal age; not having a driver's license when participating in traffic; not wearing a helmet and other similar violations. The Provincial People's Committee also requires strict handling of the responsibility of individuals who hand over vehicles to unqualified people according to the provisions of law; providing information about students who violate regulations on ensuring traffic order and safety to educational institutions for coordination in handling and education.

Point d, Clause 5, Article 30, Decree 100/2019/ND-CP on administrative sanctions for violations in the field of road and railway traffic stipulates: Fines from VND 800,000 to VND 2,000,000 for individuals, from VND 1,600,000 to VND 4,000,000 for organizations that are owners of motorbikes, scooters and similar vehicles to motorbikes for the following violations: Handing over the vehicle or allowing a person who does not meet the conditions prescribed in Clause 1, Article 58 of the Law on Road Traffic to drive the vehicle in traffic (including cases where the driver has a driver's license but it has expired or is being revoked).
