Nghe An Provincial People's Committee has just issued Guidelines on transitional management of programs, tasks, and public investment projects in the process of rearranging and perfecting the organizational apparatus of Nghe An provincial government.

Principles in transitioning program management and project tasks:

The handover and acceptance of plans, programs, tasks, and public investment projects between agencies when arranging and perfecting the organizational apparatus is carried out according to the principle ofreceive allPrograms, tasks, projects, and capital plans within the scope of management. In case of difficulties or problems after receiving, report to competent authorities for consideration and handling in accordance with regulations.

Minimize fluctuations in project management, it is necessaryclearly define tasks, powers and responsibilitiesof each party for the program, project tasks and public investment capital plan in each assigned management stage; tasks, powers and responsibilities of each party in handing over and receiving management of the program, tasks, project and capital plan.

Ensuring continuity in the implementation of programs, tasks, projects and public investment plans, and necessary transitional plansensure feasibility, can be implemented quicklyso that the capital allocation and the organization of the implementation of programs, tasks and projects are not interrupted or delayed during the process of arranging and perfecting the organizational apparatus; ensuring the progress of implementation and disbursement of the 2025 public investment plan assigned by the Provincial People's Council and the Provincial People's Committee.

For contents related to program, task and project management beyond the scope of regulation according to the provisions of the Law on Public Investment, they shall be implemented according to specialized laws.

Regarding the transition plan for managing programs, tasks, projects and public investment plans:

Case 1:02 Departments merged, forming a new Department(such as merging the Department of Planning and Investment and the Department of Finance, the Department of Transport and the Department of Construction, the Department of Natural Resources and Environment and the Department of Agriculture and Rural Development, the Department of Information and Communications and the Department of Science and Technology, the Department of Culture and Sports and the Department of Tourism, the Department of Labor, War Invalids and Social Affairs and the Department of Home Affairs).

After the competent authority decides on the merger: The head of the new Department is responsible for receiving and synthesizing all programs, tasks, projects, and capital plans under the management of the two Departments before the merger, reporting to the Department of Planning and Investment and the Department of Finance (after the merger) to synthesize and report to the Chairman of the Provincial People's Committee to assign the investor's tasks to the new Department after the merger. The management of programs, tasks, projects, and capital plans is carried out by the investor in accordance with the provisions of the Law on Public Investment and related laws.

Case 2:01 Department transfers functions and tasks to many other Departments or agencies(The Department of Labor, War Invalids and Social Affairs transfers some functions and tasks to the Department of Health, Department of Education and Training, and the Ethnic Committee; the Department of Home Affairs transfers the functions, tasks, and organizational structure of the Religious Committee under the Department of Home Affairs to the Ethnic Committee).

- Before transferring functions and tasks,Head of the Department of Transfer of FunctionsResponsible for identifying and dividing specific programs, tasks, projects and capital plans according to the transferred fields, and sending them to the receiving departments and branches corresponding to the transferred fields.

- After the competent authority decides on the organizational restructuring, the receiving department or branch is responsible for receiving the transfer of programs, tasks, projects and capital plans according to the transferred field and according to the division plan determined by the head of the department transferring the function.

- The receiving department or branch will synthesize the list of programs, tasks, projects and capital plans to be transferred and send a report to the Department of Planning and Investment and the Department of Finance (after consolidation) to synthesize the report to the Chairman of the Provincial People's Committee to assign the investor task to the receiving department or branch.

The management of programs, tasks, projects and capital plans is carried out by investors in accordance with the provisions of the Law on Public Investment and related laws.

Case 3:Receiving tasks from the Ministry to the locality, no change in legal entity after arrangement(The Department of Industry and Trade received the original status of the Local Market Management Department from the Ministry of Industry and Trade and reorganized it into the Market Management Department under the Department of Industry and Trade).

Assign the Department of Industry and Trade to preside over and coordinate with the Ministry of Industry and Trade to advise the Provincial People's Committee on the plan to receive and hand over programs, tasks, projects, capital plans (if any) and implement the contents according to the instructions of the Ministry of Industry and Trade.

On implementation organization and progress:

+ Departments and branches in the arrangement:

- Proactively review the list of programs, tasks, projects and assigned capital plans to develop a handover and acceptance plan when implementing the arrangement and consolidation of the organizational apparatus, and complete it in advance.February 18, 2025.

- Based on the instructions in this document, proactively guide affiliated investors on reviewing programs, tasks, projects, handover and acceptance between units when implementing the arrangement and consolidation of the organizational apparatus.

- The Department of Labor, War Invalids and Social Affairs and the Department of Home Affairs are responsible for reviewing and determining the specific division of programs, tasks, projects and capital plans under their management according to the fields to hand over to the respective Departments and branches after the organization and apparatus are reorganized and consolidated; sending the specific division plan of programs, tasks, projects and public investment plans according to the transferred fields to the receiving Departments and branches corresponding to the fields transferred first.February 18, 2025.

- Immediately after the competent authority's decision on the arrangement and consolidation of the organizational apparatus, the Departments and branches shall receive and synthesize the list of programs, tasks, projects and capital plans and send reports to the Department of Planning and Investment and the Department of Finance (after consolidation) to synthesize the report to the Chairman of the Provincial People's Committee to assign the tasks of investors for the programs, tasks and projects. The assigned investors shall be responsible for organizing the management and implementation of programs, tasks and projects in accordance with the provisions of the Law on Public Investment and related laws.

+Department of Planning and Investment, Department of Finance (after merger):

- Preside and coordinate with Departments and branches to synthesize and report to the Provincial People's Committee to decide or submit to competent authorities to decide on adjusting the Medium-term Public Investment Plan for the period 2021-2025 and the Public Investment Plan for 2025 for investors to implement.

- Coordinate with the Ministry of Planning and Investment and the Ministry of Finance (after the merger) to ensure the adjustment and synchronization of information and data of programs, tasks, and public investment projects using the central budget of the Departments and branches subject to arrangement on the National Information System and Database on Public Investment quickly, effectively, accurately, and without interruption in the work of monitoring, evaluating, and synthesizing projects and public investment capital plans.

- Preside and coordinate with relevant agencies to report to the Ministry of Planning and Investment and the Ministry of Finance (after consolidation) on plans to adjust loan agreements signed with international partners for projects using ODA capital related to Departments and branches subject to organizational restructuring and consolidation.

- Coordinate with agencies and units in financial and budget management on electronic systems for financial, budget and treasury management.

+ Nghe An State Treasury:

Coordinate with investors in the process of comparing and determining investment capital settlement data of projects to serve the task of handing over to investors in the process of arranging and perfecting the organizational apparatus.

+People's Committees of districts, cities and towns:

Pursuant to Instruction No. 259/HD-BKHĐT of the Ministry of Planning and Investment and the guidance content in this document to guide and organize implementation in the area to ensure timeliness and compliance with regulations.

In the process of implementation, if there are any difficulties or problems, agencies, units and localities are requested to promptly report to the Department of Planning and Investment and the Department of Finance for synthesis and consultation with the Provincial People's Committee for consideration and handling according to regulations./.
