Fine up to 40 million VND for drinking alcohol while participating in traffic during Tet

According to recent statistics from the Ministry of Public Security, in road traffic accidents, the rate of accidents caused by drinking alcohol accounts for 70 - 90%. According to statistics from the Ministry of Health, our country ranks second in Southeast Asia, 10th in Asia and 29th in the world in alcohol and beer consumption.
Before and after Tet, or on holidays, alcohol consumption skyrockets, leading to the risk of traffic accidents. Alcohol is warned to be a severe hallucinogen for the nervous system, causing the nervous system to lose self-control, orientation, and motor control. Because of being drunk, unable to control the steering wheel, and having difficulty handling situations, many people have unintentionally "sentenced death" without prior notice to other road users, or sometimes, they have sent "sentenced death" to themselves.

Lawyer Nguyen Van Hung - Director of Phuc Khanh Hung Law Firm said: "Using alcohol while participating in traffic is an act strictly prohibited by law. If violated, depending on the severity, violators will be handled according to different sanctions from administrative sanctions to criminal prosecution."
Decree No. 100/2019/ND-CP regulating administrative sanctions for violations in the field of road and railway traffic stipulates:
- For drivers of cars and vehicles similar to cars:
+ A fine of VND 6,000,000 to VND 8,000,000 shall be imposed on drivers whose blood or breath alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. The driver shall also be subject to an additional penalty of having his/her driving license revoked for 10 to 12 months.
+ A fine of VND 16,000,000 to VND 18,000,000 shall be imposed on drivers whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath. The driver shall also be subject to an additional penalty of having his/her driving license revoked for 16 to 18 months.
+ A fine of 30,000,000 VND to 40,000,000 VND shall be imposed on drivers whose blood or breath alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/1 liter of breath; or who do not comply with the request of an officer on duty to check the alcohol concentration. The driver shall also be subject to an additional penalty of having his/her driving license revoked for 22 to 24 months.
- For drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes:
+ A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on drivers whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath. The additional penalty is the revocation of the driver's license for 10 to 12 months.
+ A fine of VND 4,000,000 to VND 5,000,000 shall be imposed on drivers who do not comply with the request of law enforcement officers to check for drugs or alcohol levels; Driving on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath. The additional penalty is the revocation of the driver's license for 16 to 18 months.
+ A fine of VND 6,000,000 to VND 8,000,000 shall be imposed on drivers whose blood or breath alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/1 liter of breath; or who do not comply with the request of an officer on duty to check their alcohol concentration. The driver shall also be subject to an additional penalty of having his/her driving license revoked for 22 to 24 months./.
