The National Assembly allows to extend the disbursement of compensation funds for land clearance on National Highway 1A through Nghe An until 2025.
National Assembly Chairman Tran Thanh Man has just signed and issued Resolution No. 159/2024/QH15 of the National Assembly on the State budget estimate for 2025.

Regarding Nghe An, in the Resolution, the National Assembly allowed to extend to 2025 the implementation and disbursement of a maximum of VND 579,306 billion of the capital plan from the 2022 central budget revenue increase that has not been fully disbursed, to resolve compensation for site clearance (including the delayed payment) of the National Highway 1 expansion projects through Nghe An province under the central budget tasks arising after these projects have been finalized.
Previously, at the 6th Session taking place in October and November 2023, the 15th National Assembly agreed to add 1,275 billion VND in investment expenditure for Nghe An province from the increased central budget revenue in 2022, to resolve compensation for site clearance (including late payment) of the National Highway 1 expansion projects through Nghe An province under the central budget tasks arising after these projects are finalized.
The National Assembly assigns the Government to be responsible for the content of the proposal, the accuracy of information, data, and legal basis when implementing it, and to only pay for obligations under the State's responsibility, ensuring that no complaints arise.
Immediately afterwards, the Prime Minister issued Decision 1702/QD-TTg dated December 27, 2023 on assigning the estimate and plan for investment of central budget capital in 2023 from the source of increased central budget revenue in 2022 to the People's Committee of Nghe An province.
After that, Nghe An established a Steering Committee for compensation payment for land clearance on National Highway 1A, headed by Member of the Provincial Party Standing Committee and Permanent Vice Chairman of the Provincial People's Committee Le Hong Vinh.
Nghe An Provincial People's Committee issued Decision 1993/QD-UBND on allocating additional central budget estimates, in which 1,275 billion VND was allocated to localities including: Vinh City (21,912 billion VND), Hoang Mai Town (618,017 billion VND), Dien Chau District (512,299 billion VND), Quynh Luu District (122,772 billion VND) to pay for cases affected by the National Highway 1A expansion and upgrading project that meet the conditions under the law.
However, due tosome problems, especially determining the origin of the land to complete legal procedures, so according to calculations, by the end of 2024, it is not possible to disburse all of the above funds.
Nghe An Provincial People's Committee reported to the Central ministries and branches to submit to the National Assembly the disbursement commitment data in 2024 (more than 695 billion VND) and proposed to allow the disbursement of the remaining funds (579,306 billion VND) to be extended in 2025.
On December 5, Permanent Vice Chairman of the Provincial People's Committee Le Hong Vinh issued a document urging to speed up the progress.project fundingcommitted in 2024 this December, facing the risk that some localities will not disburse all funds, leading to having to return the budget.
The project to upgrade and expand National Highway 1A through Nghe An province has a total length of 73.8km, passing through Hoang Mai town, the districts of Quynh Luu, Dien Chau, Nghi Loc and Vinh city, invested with government bond capital and BOT form.
The project was completed on schedule as required and put into use at the end of 2014. In 2016, the Ministry of Transport completed the settlement of investment component projects using government bond capital; in 2019, the settlement of investment component projects under the BOT form was completed, including the settlement of site clearance sub-projects.
However, due to the fact that during the implementation process, some issues related to site clearance have not been thoroughly resolved, after completion, many citizens have filed complaints to authorities at all levels and People's Courts at all levels, requesting compensation for the land area of households located within the traffic corridor that was cleared during the implementation of the PMU1 Project in the period of 1994 - 1998, but previously only compensation for assets on the land, not compensation for land.
Based on the proposal of Nghe An Provincial People's Committee, in 2020, the Project was granted an additional amount of VND 222,388 billion from Government bond capital to prioritize cases of land use before 1982, eligible for compensation according to the provisions of law (concluded through the settlement of petitions and complaints).
However, households affected by the project but have not yet received compensation continue to complain. In order to have a source of funding to continue paying, ensure the legitimate rights of citizens and completely resolve the situation of prolonged complaints regarding the project's site clearance, Nghe An province has proposed; based on the proposal of Nghe An province, the opinions of the Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Transport, the Government has submitted and received the National Assembly's approval to allocate capital from the excess revenue of the central budget in 2022 directly to the locality to pay the people, with a total amount of 1,275 billion VND at the 6th Session.
