What level of violation will cause the inspection center's license to be revoked?
The Vietnam Register recently revoked the operating license of a motor vehicle inspection center due to "very serious" violations.
On April 19, the Vietnam Register announced that it had just issued a decision to revoke the certificate of eligibility for motor vehicle inspection activities for the 98-03D Registration Center (Bac Giang) because 7 inspectors were suspended from their jobs for 3 months at the same time. Previously, in March 2019, the 7 inspectors were involved in the issuance of fake certificates and inspection stamps (issued without inspection) for 5 trucks.

“The above inspectors were suspended from work due to violating Article 17; and the inspection center had its certificate of eligibility for inspection activities revoked due to violating Clause 5, Article 11 of Decree 139/2018 of the Government regulating the business of motor vehicle inspection services,” said the leader of the Motor Vehicle Inspection Department of the Vietnam Register.
More specifically, Article 17 of the above Decree stipulates that DKVs will be temporarily suspended from participating in inspection activities for 1-3 months in the following cases: falsifying inspection results; failing to comply with regulations, procedures, standards, technical regulations and instructions related to inspection work.
Clause 5, Article 11 stipulates: Revoking the certificate of eligibility for motor vehicle inspection activities for inspection units with 5 or more inspectors temporarily suspended or 3 or more inspectors having their inspector certificates revoked within 12 consecutive months.
Referring to situations that may cause a motor vehicle inspection center to have its license revoked by the management agency, the leader of the Motor Vehicle Inspection Department said that Article 11 of Decree 139/2018 clearly stipulates cases of revocation of the certificate of eligibility for inspection activities.
Specifically, the following cases: The certificate of eligibility for vehicle inspection activities is issued due to fraud, falsification of records, papers, and documents; intentionally erased or modified to distort the content. The vehicle inspection center stops inspection activities for more than 12 consecutive months; all vehicle inspection activities are temporarily suspended more than twice within 12 consecutive months; 5 or more vehicle inspection centers are temporarily suspended or 3 or more vehicle inspection centers have their vehicle inspection certificates revoked within 12 consecutive months; the vehicle inspection unit is dissolved.
The Vietnam Register also said that Inspection Center 98-03D is the first case nationwide to be closed under the provisions of Article 11 of Decree 139/2018 of the Government. According to general regulations, inspection units whose certificates of eligibility for inspection activities are revoked will only be considered for reissuance of the certificate after 36 months from the date of revocation.
