Accordingly, on January 11, 2016, the Department of Industry and Trade issued Official Dispatch No. 35/SCT-QLTM on reviewing the registration of contracts according to the form and general transaction conditions sent to clean water production, supply and consumption units.

Official dispatch No. 35 has the following content: “Based on Consolidated Document No. 03/VBHN-BXD dated July 30, 2014 of the Ministry of Construction on consolidating Decree No. 117/2007/ND-CP dated July 11, 2007 of the Government on production, supply and consumption of clean water and Decree No. 124/2011/ND-CP dated December 28, 2011 of the Government on amending and supplementing a number of articles of Decree 117/2007/ND-CP.

In order to properly implement regulations on production, supply, consumption of clean water and ensure consumer rights, the Department of Industry and Trade requires clean water production, supply and consumption units in Nghe An province to perform the following contents: Report on the implementation of standard contracts and general transaction conditions of the unit in the past. Violations related to consumer rights and measures taken to resolve them (if any); Re-register standard contracts and general transaction conditions on production, supply and consumption of clean water before January 30, 2016".

According to Ms. Vo Thi An - Deputy Director of the Department of Industry and Trade, in response to the press information reflecting on the registration of model contracts, the Department has re-examined the relevant legal documents and found that the Department's notice of acceptance of the model contract (implemented in 2012) is not strict, leading to impacts on consumer rights. The reason is that in 2012, when the Government issued a list of essential goods and services that must register for model contracts and general transaction conditions as prescribed in Clause 1, Article 19 of the Law on Protection of Consumer Rights, the Department of Industry and Trade implemented it while not fully grasping all the information from the relevant legal documents.

Therefore, in Official Dispatch No. 35, the Department of Industry and Trade requested water supply units to re-register model contracts and general transaction conditions in accordance with the spirit of Decree No. 117/2007/ND-CP and Decree No. 124/2011/ND-CP to ensure the rights of consumers./.
