Amendment of salary regime for civil servants

The Government has just issued Decree 117/2016/ND-CP amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces.

Decree amending and supplementing Articles 5, 7 and 11 of Decree 204/2004/ND-CP.

The Decree also amends and supplements the Professional and Technical Salary Table for cadres and civil servants in State public service units and the Table of leadership position allowances (election, appointment) in State agencies, State public service units; agencies and units under the People's Army and the People's Public Security issued together with Decree No. 204/2004/ND-CP.

Specifically, for officials currently receiving a salary at the position of senior lecturer who are appointed to the position of professor, their salary will be arranged as follows:

In case the final rank of the senior lecturer title has not been reached, the salary will be increased to the next higher rank from the date of appointment to the professor title, the time for considering the next salary increase will be from the date of keeping the old salary grade; in case the final rank of the senior lecturer title has been reached, an additional 3 years (36 months) will be added to calculate the seniority allowance exceeding the framework from the date of signing the decision to appoint the professor title.

The Decree also amends and supplements Clause 4, Section I of the Table of allowances for leadership positions (election, appointment) in state agencies, state-owned enterprises; agencies and units of the People's Army and People's Public Security issued together with Decree No. 204/2004/ND-CP.

Specifically, the coefficient of allowances for leadership positions of Departments under the Ministry is as follows: Department Director under the Ministry (coefficient 1.00); Deputy Department Director under the Ministry (coefficient 0.80); Head of Department (Board) and equivalent organization (coefficient 0.60); Deputy Head of Department (Board) and equivalent organization (coefficient 0.40).

Coefficient of leadership position allowance for career organizations under Departments of the Ministry: Director (coefficient 0.60); Deputy Director (coefficient 0.40); Head of Department (coefficient 0.30); Deputy Head of Department (coefficient 0.20).

In case of enjoying leadership position allowance with a higher difference between the enjoyed leadership position allowance coefficient compared to the leadership position allowance coefficient prescribed above, the enjoyed leadership position allowance will be reserved until the end of the term of holding the appointed position.

In case the position has been held for less than 6 months according to the appointed term, the position allowance that has been received for 6 months is reserved.

The Decree takes effect from September 15, 2016; abolishes the regulations on salary scales and grades for the title of professor stipulated in Clause 2, Article 8, Decree No. 141/2013/ND-CP dated October 24, 2013 of the Government detailing and guiding the implementation of a number of articles of the Law on Higher Education 2012./.
