Strengthening state management of mass associations and the use of seals of association organizations

(Baonghean.vn) - Nghe An Provincial People's Committee has just issued a Directive on strengthening state management of mass associations and the use of seals of association organizations in Nghe An province.

In recent years, associations in the province have basically operated in accordance with the law and the Association Charter. Many associations have played an active role in gathering, uniting, protecting the legitimate and legal rights and interests of members; actively propagating the Party's guidelines and policies, the State's policies and laws, and responding to patriotic emulation movements; participating in providing services, carrying out charitable and humanitarian activities, overcoming the consequences of natural disasters; participating in consulting and social criticism of socio-economic development programs and projects of the province; promoting people-to-people diplomacy; taking care of community health... The effectiveness of associations' operations has contributed to the stability and socio-economic development of the province in recent years.

However, there are still some associations that do not operate in accordance with the provisions of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations; Decree No. 33/2012/ND-CP dated April 13, 2012 of the Government amending and supplementing a number of articles of Decree No. 45/2010/ND-CP and guiding documents for implementation such as: Activities are still formal, ineffective, low initiative; have not properly implemented the principles of voluntariness, self-management, self-financing, still relying on the support of the State; the management of members and the organization of activities of the association's leadership are not strict, many associations have expired their terms but have not held congresses; some associations have not met the aspirations and legitimate interests of members.

The above situation is due to many reasons, mainly because some Party committees and authorities have not paid due attention to the leadership and direction of association activities. Awareness of association organizations is not adequate, state management of associations by departments, branches, and localities is still limited. Inspection and supervision of associations have not been carried out regularly and promptly; there have not been practical solutions to direct the removal of difficulties and obstacles to improve the effectiveness of association organizations.

To overcome the above-mentioned shortcomings and limitations and strengthen state management of associations, creating conditions for associations to organize and operate effectively and in accordance with the law; the Provincial People's Committee requests directors of departments; heads of sectors and branches; Chairmen of People's Committees of districts, cities, towns and associations in the province to focus on implementing the following key tasks:

1. Continue to thoroughly grasp and seriously implement Directive No. 17-CT/TW dated August 28, 2012 of the Politburo on continuing to innovate and strengthen the Party's leadership over mass organizations; Conclusion No. 64-KL/TW dated May 28, 2013 of the 11th Party Central Committee on a number of issues on continuing to innovate and perfect the political system from the Central to the grassroots level. Strengthen state management of sectors, fields, and localities for associations under management; properly implement regulations on state management of associations. Associations operating in any sector or field must be subject to the management of the state management agency for that sector or field.

2. The establishment of an association must stem from the legitimate needs of the masses and comply with the provisions of law; a newly established association must not overlap with an association that has been legally established in the same locality. The organization of the association does not necessarily have to establish a system from the provincial to the grassroots level. The activities of the association must ensure the general principles of: voluntary, self-management, self-financing, compliance with the law and the Association's Charter. The Provincial People's Committee only provides financial support for tasks assigned to the association by the Party and the State.

Review and propose the arrangement, merger and dissolution of associations with similar fields of operation and tasks, associations with few members and ineffective operations. Implement the allocation of operating expenses for associations that have been assigned staff, and support operating expenses associated with assigned tasks.

3. Organizations and associations established not in accordance with the provisions of law and without a legal seal that has been granted a Certificate of Seal Registration by the Public Security Department shall not be accepted or processed by State administrative agencies or units.

4. Specialized management departments, People's Committees of districts, cities and towns regularly monitor and inspect the implementation of the Party's guidelines and policies, the State's policies and laws, and the implementation of the Charters of associations under their management; handle or recommend the Provincial People's Committee (through the Department of Home Affairs) to handle violations of associations according to the provisions of law, especially the establishment of spontaneous associations or associations established without proper authority, associations not operating continuously for 12 months, not complying with reporting requirements, not participating in association activities, not performing tasks prescribed in the Association Charter, not organizing congresses according to the term, having service activities, vocational training, vocational training, production, business... not in accordance with the provisions of law.

5. Associations need to regularly consolidate and improve their organizational structure and staff; innovate content and methods, improve the quality and efficiency of operations, truly meet the legitimate needs and aspirations of members; unite and gather members, protect the legitimate rights and interests of associations, members and the community; overcome the current administrative situation in the organization and operation of associations. Strictly implement the responsibility of reporting and notifying competent State agencies in cases of changes in personnel (Chairman, Vice Chairman) during the term; changes in location, headquarters of operations, etc.

Pay attention to and create conditions for associations to participate in implementing the policy of socializing activities to develop health, culture, education, etc.; participate in programs, projects, research topics, consulting, criticism and social appraisal in the field of activities of the association according to regulations; encourage associations to link their activities with the implementation of economic, cultural and social development tasks of the province.

6. The Provincial Police Department is assigned to regularly review, inspect, and proactively detect individuals and organizations that arbitrarily carve legal seals without approval from competent authorities for handling in accordance with the provisions of law.

7. The Department of Home Affairs shall preside over and coordinate with departments, branches, sectors, People's Committees of districts, cities, towns and relevant agencies and units to monitor, urge, inspect and periodically report to the Provincial People's Committee on the implementation of the contents of this Directive; promptly report and advise the Provincial People's Committee to strictly handle cases of violations of legal regulations on association work.

Requesting directors of departments; heads of departments and branches; Chairmen of People's Committees of districts, cities, towns and associations in the province to seriously implement this Directive.
