Strengthening management to prevent social insurance benefit abuse

(Baonghean) -Nghe An Provincial People's Committee has just issued Official Dispatch No. 5918/UBND-VX on strengthening management to prevent the situation of profiteering from social insurance regime.

Accordingly, to ensure proper implementation of regulations and prevent the exploitation of sickness and maternity benefits, the People's Committee of Nghe An province requests:

1. Directors of departments, heads of provincial-level departments and branches; Chairmen of People's Committees of districts, cities and towns shall promote the dissemination of social insurance regimes, policies and laws so that organizations and individuals know and implement them.

2. The Department of Home Affairs directs the inspection of the implementation of labor contract signing, salary payment, and social insurance deduction in public service units that are not in accordance with Directive No. 30/CT-UBND dated October 28, 2013 of the Provincial People's Committee, and reports to the Provincial People's Committee before September 30, 2017.

3. The Department of Health directs medical facilities to issue Hospital Discharge Certificates, Birth Certificates, and Certificates of Leave from Work for Social Insurance in accordance with Circular No. 14/2016/TT-BYT dated May 12, 2016 of the Ministry of Health; issue them fully and promptly to employees and be legally responsible for the accuracy and honesty of the issuance of records and documents; do not issue fake Birth Certificates or Certificates of Leave from Work for Social Insurance.

4. The Department of Labor, War Invalids and Social Affairs directs employers to develop salary scales according to the provisions of Decree No. 49/2013/ND-CP, and coordinates with the provincial Social Insurance to inspect and handle employers who do not comply with the regulations on social insurance contributions according to the Social Insurance Law.

5. The provincial police will coordinate with the Social Insurance agency to investigate and clarify the act of buying and selling fake documents and strictly handle them according to the provisions of law.

6. Nghe An Provincial Social Insurance strengthens inspection and examination of social insurance registration, social insurance benefit records, reports to the Provincial People's Committee to strictly handle groups and individuals lacking a sense of responsibility or intentionally violating; proactively coordinates with the Department of Labor - Invalids and Social Affairs, the Labor Federation to organize dialogues with businesses and employees, guides units to register to participate in the correct number of people, time and level of social insurance, health insurance, unemployment insurance; promptly resolves difficulties and problems for units.

7. People's Committees of districts, cities and towns:

- Actively coordinate with the Social Insurance agency to strengthen inspection and examination of compliance with State regulations on Social Insurance;

- Direct the People's Committees of communes, wards and towns in the area to strictly implement regulations on issuing birth certificates and death certificates.

According to the report of Nghe An Provincial Social Insurance, in recent times, the situation of profiteering from sickness and maternity benefits has tended to increase in many different forms such as: Increasing the compulsory social insurance contribution level to an unusually high level, not in accordance with the actual salary and wages paid to employees within 12 months before giving birth to enjoy maternity benefits with a large amount of money; preparing documents to request the collection of compulsory social insurance payment time for the wrong subjects, registering to participate in social insurance but not actually working to receive salary and wages at the unit (submitting payment); signing labor contracts that are not in accordance with the provisions of Directive No. 30/CT-UBND dated October 28, 2013 of the Provincial People's Committee; buying and selling fake documents to pay social insurance benefits. The above acts have seriously violated the Law on Social Insurance, causing losses to the Social Insurance Fund.
