Focus on resolving bank credit cases, complex and prolonged cases
(Baonghean.vn) - On the morning of November 22, the People's Committee of Nghe An province held an online conference to summarize the enforcement of civil and administrative judgments in 2022 and deploy the implementation of targets and tasks in 2023.
Attending the conference were comrades: Nguyen Quang Thai - General Director of the General Department of Civil Judgment Enforcement - Ministry of Justice; Le Hong Vinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee - Head of the Steering Committee for Civil Judgment Enforcement of Nghe An province; Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the National Assembly Delegation of Nghe An province; and representatives of provincial departments, branches and sectors; and district-level connecting points.

Completed 15,059 tasks
In 2022, the enforcement agencies completed 15,059 cases/17,649 cases with conditions for enforcement out of a total of 20,559 cases requiring enforcement; completed more than VND 535 billion/VND 1,968.7 billion in money.
Regarding the enforcement of credit and banking judgments, the enforcement agencies have also completed 131/515 cases, equivalent to more than 233 billion VND. The enforcement agencies also coordinated with relevant units and departments to enforce judgments on 127/361 cases with a total of more than 29 billion VND out of a total of more than 72 billion VND related to assets appropriated and lost in criminal cases of corruption and economic crimes that must be recovered.

In addition, the agenciescivil enforcementAlso coordinated with the People's Procuracy at the same level to review, prepare records and propose to the competent People's Court to consider exemption or reduction of 141 cases with the amount of 727,627,000 VND. Issued a decision to apply compulsory enforcement measures to 223 cases. Of which, 37 cases involved parties voluntarily enforcing the judgment, 186 cases required compulsory enforcement. There were 134 successful enforcement cases (of which 79 were enforced with the mobilization of inter-sectoral forces), 52 cases are under the process of developing a plan to organize enforcement.
On administrative enforcement in 2022Provincial Civil Judgment Enforcement Agencyalso received and resolved 4/14 judgments, at the same time clearly defined responsibilities, methods, ways and procedures to enforce administrative judgments.
At the conference, the chairmen also listened to many comments from localities and units. Mr. Nguyen Van Thuong - Vice Chairman of the People's Committee of Quynh Luu district said that Quynh Luu is the locality with the second largest number of cases requiring enforcement in the province. In which, the number of complicated cases is increasing. Many cases are difficult to enforce because they are related to land disputes, disputes over inheritance rights, mortgages, hui... The representative of Quynh Luu district said that there should be a solution to issue coordination regulations between levels and sectors so that the enforcement of civil judgments can be more effective, avoiding cases that are too long and drag on for many years.

Mr. Dang Van Hai - Head of the Vinh City Civil Judgment Enforcement Office shared his experience in coordinating with internal affairs agencies in the enforcement of judgments. Mr. Hai said that since 2012, the unit has coordinated with the police to call the parties in gambling cases to the City Police to pay court fees and fines in gambling cases. By 2016, it had expanded to other budget payments in criminal cases. Signed a coordination regulation with internal affairs agencies such as the court and the police, which affirmed that this work is a proactive and regular work with the police of wards and communes to call and summon the subjects to pay court fees and fines in criminal cases.
Mr. Hai also recommended that it is necessary to further strengthen coordination between the police and military, especially in enforcing judgments related to explosives and flammable substances.
Some comments also suggested that the Provincial People's Committee should have a closer monitoring mechanism in the enforcement of civil judgments, to avoid cases being prolonged, causing significant impacts on the efforts and time of State agencies as well as the rights of the litigants...
Strengthening coordination and promoting the role of sectors and levels
Speaking at the conference, Mr. Nguyen Quang Thai - Director General of the General Department of Civil Judgment Enforcement - Ministry of Justice, highly appreciated the results in the enforcement of civil and administrative judgments of Nghe An province in the past time, especially after having just experienced the Covid-19 pandemic with many major impacts on the economy and society.

Although the locality has a large number of cases to be executed, thanks to the attention and direction of the Provincial Party Committee Standing Committee, the execution of judgments in Nghe An still achieved positive results. The enforcement agencies have implemented many effective solutions, mobilized the people skillfully and closely coordinated with relevant agencies, departments and branches to achieve the best results.
In addition, the Director General of the General Department of Civil Judgment Enforcement also requested civil judgment enforcement units in Nghe An to strictly grasp the tasks and policies of the Party and the regulations of the province to carry out their tasks. Specify the targets and tasks set out; deploy focused and key solutions for major cases. Focus on improving the quality of enforcement officers, enhancing the sense of responsibility, sense of organization, discipline, and public order in civil judgment enforcement agencies. Do a good job of mass mobilization work with the view that the fewer cases that need enforcement, the better.

Receiving and acknowledging the instructions and comments of the Director General of the General Department of Civil Judgment Enforcement, comrade Le Hong Vinh said that in the coming time, Nghe An will continue to closely follow, thoroughly grasp, disseminate and ensure strict implementation of the Resolutions and action programs of the Ministry of Justice in the enforcement of civil and administrative judgments.
The Standing Vice Chairman of the Provincial People's Committee also directed the units to focus on directing the resolution of cases, bank credit cases, major cases, and long-standing complicated cases. Do a good job of advising the Party Committee and the government in organizing the execution of judgments, identifying this as the task of the entire political system, not just the Civil Judgment Enforcement Agency, especially in localities with a lot of work and money. Focus on improving the quality of the staff, strengthening discipline in the execution of civil and administrative judgments.

Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh also requested departments, branches, sectors and localities to actively coordinate and support functional agencies in the enforcement of civil and administrative judgments. Strengthen coordination and promote the role of sectors and levels in the enforcement of judgments, especially sectors in the Internal Affairs, Finance, Natural Resources and Environment sectors... Avoid complicated and prolonged cases that affect the economic, social, security and political situation in the province.
