'Vinh City has not fully fulfilled its responsibilities in managing urban order.'

(Baonghean.vn) - The management of urban construction order for construction projects in Vinh City has been fraught with shortcomings and limitations; many enforcement decisions have been issued but not yet implemented. This was a hot topic at the questioning session of the Vinh City People's Council on the morning of December 21st.

According to Vice Chairman of Vinh City People's Committee Le Sy Chien, the reason why urban construction order management for construction projects in the city has been inadequate and limited in recent times is due to the fault of investors with limited capacity and a lack of understanding of investment and construction laws.

Mr. Le Sy Chien, Vice Chairman of the Vinh City People's Committee, explained that the management of urban construction order for construction projects in the city has had many shortcomings and limitations in the past.

Some households and individuals, due to pressure regarding housing and construction deadlines, and some businesses, due to pressure for business efficiency, intentionally violate regulations and are willing to pay administrative fines to continue construction, disregarding suspension orders; they have not fully complied with regulations such as environmental protection, installing unsafe construction equipment; leaving materials obstructing public traffic; and construction methods approved by the investor are inappropriate, affecting the quality of neighboring structures.

Meanwhile, some local authorities and officials at the ward and commune levels tasked with managing construction order in their areas lack responsibility, thoroughness, and timeliness in inspecting and detecting violations.

The coordination between provincial departments and agencies and the City People's Committee, and between the City People's Committee and the People's Committees of wards and communes, and relevant affiliated units in providing information, inspecting, monitoring, and promptly handling projects violating construction regulations has not been truly timely or effective.

The Truong Thanh 2 apartment and townhouse complex, developed and constructed by Truong Thanh Co., Ltd. in Block 5, Truong Thi Ward - where an accident resulting in the death of a 10th-grade student occurred - has not been granted a construction permit.

According to Mr. Chien, the responsibility for the aforementioned violations of construction regulations primarily lies with the investor who failed to strictly comply with the legal regulations on investment and construction projects.

The failure to detect, prevent, and promptly address the issue of allowing investors to commence construction without a building permit, or in violation of the permit, is the responsibility of the state management agencies for construction order in each locality (People's Committees of wards and communes) and the City Urban Order Management Team. The City Urban Order Management Team has also failed to fulfill its duties in allowing these construction order violations to occur within the city.

The city has not fulfilled its responsibilities.

Representative Nguyen Dinh Cat, Chairman of the Vinh City Fatherland Front Committee, expressed concern about the city's proposed solutions for urban order management, deeming them too "thin." "I suggest the city needs to clearly state effective solutions for urban order management, especially the responsibilities of wards, communes, and urban regulations teams," Representative Nguyen Dinh Cat stated.

Regarding the management of planning and construction of apartment complexes, delegate Nguyen Huu Trung - Secretary of the Party Committee of Hung Loc commune - pointed out the reality of the increasing density of apartment complexes; the proliferation of high-rise apartment buildings within residential areas and near main roads is causing problems for people's lives and traffic safety. What is the responsibility of Vinh City in controlling, ensuring, and regulating the planning of apartment complexes?

Delegate Nguyen Dinh Cat - Chairman of the Vinh City Fatherland Front Committee - suggested that the city needs to clarify solutions to improve the effectiveness of state management in urban order management.

Responding to questions from Delegate Cat, Mr. Le Sy Chien stated that the city has issued four groups of solutions to improve the effectiveness of urban order management. Mr. Chien agreed with Delegate Cat's suggestion to link the responsibilities of wards, communes, and the city in managing urban order and include this in the annual performance evaluation criteria.

Regarding the urban regulations enforcement teams at the ward and commune levels, Mr. Chien stated that in the near future, the city will pursue a policy of professionalizing and formalizing this team. Simultaneously, coordination between the urban regulations enforcement teams and the police and urban inspectorate forces will be strengthened. Mr. Chien emphasized that for urban order management to become increasingly effective, the entire political system needs to be involved.

Representative Tran Thi Cam Tu, Chairwoman of the Vinh City Party Committee's Inspection Committee, suggested that the city needs to clarify responsibilities in the management of apartment complexes.

Regarding the management of apartment building construction planning, Mr. Le Sy Chien explained clearly: All those projects fall under the decision-making authority of the province and the Department of Construction. Vinh City only has the right to agree on the planning, and its responsibility is to manage construction order. In the future, the city will enhance its responsibility in the planning agreement process.

Representatives Tran Thi Cam Tu - Head of the Vinh City Party Committee's Inspection Committee and Dinh Xuan Truong - Secretary of the Quang Trung Ward Party Committee questioned the city's responsibility regarding the current situation where many apartment complexes lack management boards, cultural centers, community activities, household registration, rights, and obligations, and the developers do not allocate funds for apartment maintenance. Many developers do not adhere to the original planning. What solutions will the city implement in the future to establish residential blocks and manage household registration issues in these apartment complexes?

Vinh City authorities are taking action against violations on Nguyen Van Cu street.

Responding to questions from delegates, Mr. Le Sy Chien stated: The primary responsibility for this situation lies with the investors. To manage these apartment complexes, the People's Committee of Vinh City has issued a plan, coordinating with the Vinh City Police to review household registration and residency records in these complexes and establish residential blocks and neighborhoods within them. The city will be responsible for inspecting and urging investors to adhere to the original planning.

Regarding the inspection and handling of urban order violations, delegate Do Dinh Quang, Chairman of the Vinh City Labor Union, suggested that the city needs to clarify the solution for resolving the 77 cases of construction violations without permits that were discovered during inspections. Clarifying delegate Quang's point, Mr. Le Sy Chien stated that the city will review each case individually to find solutions in accordance with the law.

The issue of urban construction order management regarding construction projects has attracted attention and generated many questions from Vinh City People's Council representatives. These questions focused on clarifying the roles and responsibilities of wards, communes, departments, and the leadership of Vinh City in managing urban construction order, highlighting numerous shortcomings and inadequacies in the area.

Comrade Nguyen Van Lu, Standing Deputy Secretary of the City Party Committee and Chairman of the Vinh City People's Council, concluded the questioning session.

Concluding the questioning session, Mr. Nguyen Van Lu, Permanent Deputy Secretary of the City Party Committee and Chairman of the Vinh City People's Council, also stated that the shortcomings and inadequacies in urban order management are due to the city not fully fulfilling its responsibilities. Inspection, monitoring, and handling of violations have not been resolute enough.

The comrade suggested that the city needs to enhance responsibility and consistency in planning agreements and adjustments; and be more resolute in handling violations. Wards and communes need to uphold their roles and responsibilities in managing urban order.

In the coming period, the City People's Council will conduct thematic supervision on urban order management, proposing that the city decentralize and clearly define the responsibilities of individuals and collectives to find solutions; and establish mechanisms and policies to reorganize the staff in charge of this work and the urban regulations teams in wards and communes. The entire political system will participate in bringing urban order management into order, ensuring civility and discipline for the common goal of building a civilized and modern Vinh city.
