The Ministry of Construction has just issued Circular No. 02/2018/TT-BXD regulating the environmental protection responsibilities of project owners and contractors in the execution of construction works. This Circular will take effect from April 1, 2018.
Accordingly, the project owner will be responsible for: Developing an environmental management and protection plan based on the environmental management program in the environmental impact assessment report approved by the competent authority or the environmental protection plan confirmed by the competent authority according to regulations.
The Circular clearly stipulates the responsibilities and reporting regime in environmental protection work of project owners as well as construction contractors during the construction process. Prepare a written environmental protection report periodically 01 (one) time/year and send it to the Department of Construction before December 31 every year.

Arrange environmental personnel in accordance with environmental protection laws to inspect and supervise contractors in implementing environmental management and protection plans and environmental protection regulations in construction.
Suspend construction and require the contractor to take corrective measures to ensure environmental protection requirements when discovering that the contractor has seriously violated environmental protection regulations during construction or there is a risk of a serious environmental incident.
The responsibilities of the construction contractor will be: Implement the environmental management and protection plan and regulations on environmental protection during the construction of the package.
For the Department of Construction of provinces and cities, it is responsible for: Preparing a written report on environmental protection work periodically 01 (one) time/year according to the form in Appendix 2 issued with this Circular and sending it to the Ministry of Construction before January 15 of the following year.
