From August 1, fine up to 800,000 VND for using phone with hands while driving

From August 1, Decree 46/2016/ND-CP will take effect and will impose a fine of up to VND800,000 for using a phone while driving.

The act of "using a phone with hands" while driving a car is a completely new act, detailed in Decree 46/2016/ND-CP, while the previous Decree 171/2013/ND-CP did not regulate this act.

In practice, this behavior is very dangerous for the person sitting in the car and other road users. If the driver is driving and one hand is used for the phone, he will not be flexible in handling situations that arise on the road.

Because the regulation only punishes the act of "using hands", using headphones to listen to the phone is not covered by this regulation.

Article 5. Penalties for drivers and passengers of automobiles and similar vehicles violating road traffic rules

3. A fine of 600,000 VND to 800,000 VND shall be imposed on a driver who commits one of the following violations:

a) Driving a vehicle at a speed exceeding the prescribed speed from 05 km/h to under 10 km/h;

b) Continuously honking, revving the engine; honking the horn, using high beams in urban areas and densely populated areas, except for priority vehicles on duty as prescribed;

c) Changing direction without slowing down or signaling (except when driving along a curved road section where the roads do not intersect at the same level);

d) Failure to comply with regulations on stopping and parking at road intersections at the same level as railways; stopping and parking within the safety zone of railways, except for violations specified in Point b Clause 2, Point b Clause 3, Article 48 of this Decree;

d) Stopping or parking a vehicle at the following locations: On the left side of a one-way street; on a curved section of road or near the top of a slope where visibility is obstructed; on a bridge, under an overpass, parallel to another vehicle that is stopping or parking; at a road intersection or within 05 m from the edge of the intersection; at a bus stop; in front of or within 05 m on both sides of the gate of an agency or organization with a road for cars to enter and exit; where the road section is only wide enough for one lane; obscuring road signs;

e) Parking a vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25 m from the curb or sidewalk; parking a vehicle on a tramway or bus lane; parking a vehicle on a drainage manhole, a telephone or high-voltage power line, or a space reserved for fire trucks to get water; parking or leaving a vehicle on the sidewalk in violation of the law; parking a vehicle where there is a "No Parking" sign or a "No Stopping and Parking" sign, except for the violation specified in Point c Clause 7 of this Article;

g) Not using or not using enough lighting from 7:00 p.m. the previous day to 5:00 a.m. the following day, when fog or bad weather limits visibility; using high beams when avoiding oncoming vehicles, except for violations specified in Point c, Clause 6 of this Article;

h) Driving a car towing another vehicle or object (except in the case of towing a trailer, semi-trailer or another specialized car or motorbike when this vehicle cannot move by itself); driving a car pushing another vehicle or object; driving a car towing a trailer or semi-trailer towing another trailer or other vehicle or object; not securely and safely connecting the towing vehicle and the towed vehicle when towing each other;

i) Carrying people on the towed vehicle, except the driver;

k) Making a U-turn at a road intersection with a railway;

l) Using a mobile phone with your hands while driving on the road.
