The Provincial People's Committee authorizes the District People's Committee to decide on specific land prices.

The Government has just issued Resolution No. 73/NQ-CP dated May 6, 2023 on the authorization to decide on specific land prices.

The Resolution clearly states: People's Committees of provinces and centrally run cities, based on the provisions of the Law on Organization of Local Government, Conclusion No. 14-KL/TW dated September 22, 2021 of the Politburo and the actual situation of the locality, shall delegate authority to the People's Committees at the district level:

1. Decide on specific land prices to calculate compensation when the State reclaims land; collect land use fees when allocating land for resettlement; calculate land use fees and land rent when the State allocates land, leases land, or changes land use purposes to households and individuals; determine land prices for areas exceeding the limit when the State recognizes residential land use rights for households and individuals; determine starting prices for auctioning land use rights for households and individuals.

2. Decision to establish a Land Valuation Council, Council members include: Chairman of the District People's Committee as Chairman of the Council and leaders of the district-level financial agency as Standing Committee of the Council; leaders of the natural resources and environment agency, relevant district-level professional agencies and leaders of the People's Committee of the commune where the land is located; organizations with the function of consulting on land valuation or land price experts and other members decided by the District People's Committee. The District Department of Natural Resources and Environment assists the District People's Committee in organizing land valuation.

The Resolution also requires the People's Committees of provinces and centrally run cities to ensure financial conditions, human resources and other necessary conditions for the People's Committees at the district level to decide on specific land prices as authorized under the above provisions; guide and inspect the implementation of delegated tasks and powers and be responsible for the results of the implementation of the tasks and powers they have delegated; strengthen inspection, supervision and control of power, combat negativity, corruption, waste and abuse of policies for personal gain.

This Resolution takes effect from the date of signing (May 6, 2023) and is implemented until the Land Law (amended) is passed by the National Assembly to replace the 2013 Land Law that comes into effect.
