(Baonghean.vn) - That is the opinion of Colonel Tran Hai Binh - Commander of the Provincial Border Guard Command at the meeting to collect comments on the Draft Law on Vietnam Border Guard.

On the morning of September 16, the Provincial National Assembly Delegation held a conference to collect comments on the drafting of the Vietnam Border Law. Comrade Tran Van Mao - Deputy Head of the Provincial National Assembly Delegation chaired the conference. Representatives from relevant departments, agencies, sectors and units attended.

Building a common mission to protect the border

After listening to comments and discussions, including the delegates' proposals to amend and supplement a number of contents of the Draft Law on Vietnam Border Guard, the representative of the CommandProvincial Border GuardThere were discussions and expressed the hope that the Draft Law on Vietnam Border Guard will be developed and promulgated in the spirit of building a common mission, all for the sake of everyone.border peaceColonel Tran Hai Binh - Member of the Provincial Party Committee, Commander of the Provincial Border Guard Command expressed that, in addition to professional duties, the Border Guard force also participates in activities and undertakes many responsibilities in the border area with dedication.

In addition to the task of protecting the border, border guards also participate in economic and cultural development, participate in educational work, build new rural areas, and provide health check-ups for people... all of these activities aim to protect security and order, and build the economy, culture, and society in the country.border. Although the Vietnam Border Law stipulates which force takes the lead and which forces coordinate, the border guards always strive for the peaceful life of the people in the area under their responsibility.

Comments on Article 34 on the regulations: responsibilities of People's Committees and People's Councils at all levels in coordinating and supporting the border guard force in their work, some delegates said that it is necessary to have more specific regulations for easy application in practice. For example, in mobilizing resources, setting out priority policies for the border guard force, and activities in border areas, only the provincial level has the authority. Therefore, it is necessary to add the phrase "according to authority" so that People's Committees and People's Councils at all levels have a basis for implementation. Or as for the regulations on priority policies on land and housing for local Border Guard officers and soldiers, it is necessary to clearly state how long the "long-term working" period is, because the border guard force regularly transfers its troops.

Concerns about overlapping laws

At the conference, delegates also expressed concerns about some provisions of the Draft.Vietnam Border LawThere are overlapping signs with other laws, related to other sectors such as police, customs, coast guard...

The representative of the provincial Fatherland Front affirmed that the provisions of the Vietnam Border Law are basically reasonable; the regulation of the task of ensuring security, order and social safety in border areas assigned to the border force is correct. However, the phrase "the task of preventing and combating crimes according to the provisions of law" needs to be adjusted, because it may overlap with other laws, especially those related to the police force. Regarding the content of the regulation that the border force manages immigration, there needs to be a clearer explanation to avoid overlapping responsibilities of the customs force.

The representative of the Provincial Police Department proposed to amend and clarify the terms related to specific regulations on duties.protect security and order at the border,avoid overlapping with other laws related to the people's police force. The representative of the Provincial Police said that the border guard should not be defined as a specialized force to protect security and order in border areas, but should be defined as a coordinating force.

In addition, delegates also suggested that it is necessary to more clearly adjust the regulations in the border area: "when detecting law violations in the scope of many forces, the force that detects first will handle them first" will cause overlap and lack of coherence. In addition, it is necessary to link 3 areas: national defense, border defense and people's security to achieve high efficiency in performing the tasks of the forces.

The conference had 16 comments to ensure logic and clarify concepts. Delegates also commented on many specific contents of the provisions of the law on state policies, border duties, and forces performing border duties; prohibited acts, the coordination function of the forces and the functions, duties and powers of the border guards; policies and regimes for local border guards... At the same time, it was proposed to add the coordination function and duties of the Ministry of Justice to the Vietnam Border Guard Law...
