"Roll call" of the incident

Recently, Nghe An has continuously discovered many cases of organizing illegal immigration and emigration. Typically, on March 5, 2011, in the Nam Non River area of ​​Xieng Tren village, My Ly commune (Ky Son district), My Ly Border Guard Station, Nam Can International Border Guard Station, Drug and Crime Prevention Department (Nghe An Border Guard) discovered and arrested 2 subjects who organized 5 Vietnamese people to illegally exit the country to Laos. According to the initial investigation results, 2 subjects Lo Van Dau (born in 1983) and Luong Du Lan (born in 1988), residing in Xop Tu village, My Ly commune, hired to transport 5 people residing in Tan Thanh commune (Yen Thanh district) by dugout canoe across the border river to exit to Laos for a fee of 4 million VND. Information from the Nghe An Border Guard said: Currently, the case of "Organizing illegal exit for others" has been prosecuted and the subjects have been handed over to Nghe An Police for further investigation and handling according to regulations.

Previously, at 1:45 a.m. on February 21, 2011, at landmark 404 in Tien Tieu village, Nam Can commune, Ky Son district, Nam Can international border post arrested Xieng Phom My (Kham Bo, born in 1967, residing in Din Dam village, Noong Het Tay village cluster, Noong Het district, Xieng Khouang province, Laos) who was illegally taking 9 Vietnamese citizens from Vietnam to Laos. Xieng Phom My confessed that he was hired by a Vietnamese named Hanh (specific address unknown) to guide 9 Vietnamese people across the border to Laos for a salary of 5 to 7 million VND per person.

In addition to illegal exit activities, authorities have also continuously detected illegal entry into Vietnam by foreigners, with the assistance of Vietnamese people. Specifically, at 9:30 p.m. on February 25, 2021, at the Cau Mung intersection in Hung Nguyen town, Hung Nguyen district police inspected a passenger bus with license plate 20B-022.15 and discovered a group of passengers (including 1 Vietnamese and 7 Chinese) on the bus, showing many suspicious signs of illegal entry into Vietnam. Through initial verification, it is known that the 7 Chinese citizens above had gone through a number of Vietnamese people to find their way to Cambodia to work.

Immediately afterwards, the authorities issued a notice to search for a Vietnamese man named Vu Van Tinh (born in 1989), residing in Thai Nguyen province, who was primarily responsible for bringing Chinese citizens into the country and had fled. Then, on March 9, 2021, a sleeper bus carrying 53 Chinese people illegally entering the country was also discovered by the Border Guard force when passing through Hoang Mai town (Nghe An). Immediately afterwards, the authorities asked the driver to go straight to the centralized quarantine area in Hung Nguyen district to carry out the next steps, including disease prevention and control.

The act of organizing illegal immigration and emigration not only violates the law and border regulations, causing insecurity and disorder, but also makes it difficult to prevent and control the Covid-19 epidemic, potentially causing the spread of an uncontrollable epidemic.

Resolutely fight and prevent

Faced with the complicated developments of crimes of organizing others to flee abroad and brokering the illegal entry of foreigners into Vietnam, especially during the unpredictable Covid-19 pandemic, Nghe An Police have launched a high-profile campaign to combat this crime. In particular, after the Ministry of Public Security issued a directive, Nghe An Police advised the Provincial People's Committee to issue a telegram on strengthening the detection, fight, and prevention of illegal immigration. At the same time, promote communication work on mass media and loudspeaker systems in 460 communes and towns and mobile propaganda in key areas, residential areas, etc.

Thereby, in order to raise people's vigilance, coordinate with functional forces to detect and denounce crimes, Nghe An Police also directed local police to propagate and mobilize 5,932 people who had illegally left the country to commit not to continue violating the law on entry and exit; the professional departments of the Provincial Police coordinated with the Police of mountainous districts to propagate and mobilize 3,578 Mong households to commit not to migrate freely, to take care of local labor production. At the same time, organize the fight against and strictly handle crimes of illegally sending people abroad and crimes of human trafficking involving foreign elements.

Within just 7 months of implementing the peak period of fighting to prevent this type of crime, the provincial police arrested and prosecuted 12 cases, 23 defendants for the crime of "Organizing others to flee abroad or stay abroad illegally", 1 case, 1 defendant for the crime of "Organizing others to leave the country illegally"; 4 cases, 4 subjects for the act of "Organizing others to flee abroad illegally".

Strictly handle

To increase deterrence against greedy individuals who are hatching plots and tricks to organize illegal immigration, many cases have been brought to strict trial by authorities recently.

Typically, on January 19, 2021, the People's Court of Nghe An province tried and sentenced Lo Van Thai, 30 years old, residing in Thong Thu commune (Que Phong district) to 12 months in prison for organizing illegal exit for others. Because he had been to Laos to work and live, on July 10, 2020, when he received a text message and phone call asking him to take people to Laos to work without having to quarantine to prevent and fight the Covid-19 epidemic, Thai agreed and agreed to take 5 million VND as a salary. After that, Thai borrowed his father-in-law's motorbike to take Pham Hung Tien (37 years old, residing in Dien Chau district) and 2 of his friends through the forest on a small road towards Laos. When they reached the Vietnam - Laos border belt area, they were discovered and arrested by the patrol team of Thong Thu Border Guard Station.

Previously, on December 14, 2020, Lau Ba Chu (born in 1989), in Truong Son village, Nam Can commune, Ky Son district, was also tried by the People's Court of Nghe An province and sentenced to 12 months in prison for the crime of "Organizing illegal exit and entry for others". According to the indictment, due to greed, in August 2020, Chu twice helped Dau Xuan Chung (residing in Nghi Loc district) illegally exit and enter the country in the border area between Tien Tieu village (Nam Can commune, Ky Son) and Din Dam village (Noong Het district, Xieng Khouang, Laos).

Most recently, on March 2, 2021, the People's Court of Nghe An province sentenced Duong Van Manh (residing in Hung Nguyen) to 5 years in prison and Ma Dinh Thuc (residing in Cao Bang) to 2 years in prison for "Organizing others to flee abroad". According to the indictment, although they did not have the function, authority, or duty to advise or organize people to go to China, these subjects advised, guided on procedures, methods, routes, and welcomed and arranged jobs and accommodations for 8 workers who fled to China.

These are strict sentences, right on the person, right on the crime because the act of organizing people to illegally enter or exit the country across the border without the control of the authorities, especially at a time when the Government and the authorities are implementing many measures to prevent and fight the epidemic, is a violation of the law and deserves to be condemned and must be strictly handled.

However, to prevent this type of crime, in addition to the involvement of the authorities, each citizen needs to promote awareness and civic responsibility, and seriously implement the 3 no's: "no illegal immigration, no assisting in illegal activities, no picking up and dropping off illegal immigrants".
