6 agricultural sectors are regulated for investment and business conditions

The Government has just issued Decree No. 66/2016/ND-CP stipulating conditions for investment and business in plant protection and quarantine; plant varieties; raising common forest animals; livestock; aquaculture; food. The Decree takes effect from July 1, 2016.

The above Decree stipulates business conditions, including:

1- Conditions for producing plant protection drugs, except for biological plant protection drugs whose active ingredients are beneficial microorganisms; trading in plant protection drugs; organizing the practice of handling objects subject to plant quarantine; organizing the testing of plant protection drugs to register in the List of plant protection drugs permitted for use in Vietnam;

2- Conditions for business of plant variety testing services;

3. Conditions for raising common wild animals;

4. Conditions for trading in livestock breeds, semen, embryos, breeding eggs, and concentrated livestock farming of buffalo, cows, goats, sheep, horses, rabbits, pigs, chickens, ducks, geese, ostriches, quails, and swiftlets; production and processing of animal feed and aquatic feed (including biological products, microorganisms, minerals, and chemicals, except for disinfectants, antiseptics, and antiseptics used in aquaculture); trading in animal feed and aquatic feed; and business in testing services for animal feed and aquatic feed;

5. Conditions for aquatic breed production (tiger shrimp, white-leg shrimp, pangasius, tilapia, Ben Tre clams), aquaculture (tiger shrimp, white-leg shrimp, pangasius, tilapia); business of aquatic breed testing services; aquatic exploitation;

6. Conditions for food business (food; meat and meat products; aquatic products and aquatic products; vegetables, tubers, fruits and vegetable, tubers, fruits products; eggs and egg products; raw fresh milk; honey and honey products; salt; spices; sugar; tea; coffee; cocoa; pepper; cashew nuts and other agricultural products and food): food production establishments (cultivation, harvesting, breeding, aquaculture, fishing, aquatic exploitation); livestock and poultry slaughterhouses; food processing and preliminary processing establishments; agricultural wholesale markets; food trading establishments.

Conditions for investment in plant protection business

Regarding the conditions for the production of plant protection drugs, the Decree stipulates that organizations producing plant protection drugs must meet the conditions specified in Article 61 of the Law on Plant Protection and Quarantine and the detailed conditions specified in this Decree on human resources, factories, warehouses for storing plant protection drugs, equipment, and quality management systems.

Organizations and individuals trading in plant protection drugs must meet the conditions specified in Article 63 of the Law on Plant Protection and Quarantine and the conditions on human resources, location, and plant protection drug warehouse.

In addition, the Decree also stipulates that organizations practicing the treatment of objects subject to plant quarantine must meet the conditions specified in Article 37 of the Law on Plant Protection and Quarantine and detailed conditions on human resources; conditions for individuals granted a Practice Card for the treatment of objects subject to plant quarantine; and technical facilities.
