The tragedy of a 70-year-old father who accidentally beat his son to death

For many years, Mr. Man and his wife were beaten by their son when they asked for money but were not given it. One night, while arguing with his rebellious son, he swung a hoe handle in anger.

On September 5, Hanoi People's Court opened the first instance trial of Mr. Nguyen Ba Man (72 years old, in Chuong My district) for the crime ofMurder beyond the limits of legitimate defense,Article 126 of the 2015 Penal Code.

According to the indictment of the People's Procuracy, on the evening of September 15, 2017, Mr. Man and his wife were at home when their son Nguyen Ba Luc returned home drunk. Guessing that his son was still "high" on drugs, seeing Luc wanted to find someone from the same village to resolve the conflict, Mr. Man's wife quickly intervened.

Seeing his son resist and hit his mother, Mr. Man intervened and scolded him. Luc turned to his father, answered rudely and hit him. When his son threatened to "break his mother's legs", Mr. Man angrily pushed his rebellious son away and then struggled.

Luc went into the kitchen and took a wooden hoe handle nearly a meter long to hit his parents, causing the handle to break in half. When he grabbed the hoe handle, Mr. Man hit his son on the back of the neck. Luc died on the way to the emergency room due totraumatic brain injury

Standing before the witness stand, Mr. Man was thin, with white hair, wearing a hearing aid, and holding onto the table with both hands. At the investigation agency as well as in court, he admitted all the actions as prosecuted.

He said: "It happened so fast, no one wants to kill their child." Luc is his second child. Every month, father and son would have a few fights because Luc always asked for money to buy drugs. His testimony was inconsistent because sometimes he could hear the questions, sometimes he couldn't. The lawyer had to assist him many times.

Listening to Mr. Man, a judge said: "No one wants that, but because the defendant crossed the line and the victim died, it must be handled according to the law. We will consider the circumstances and testimony in court to handle it according to regulations but with a humane spirit.

Two relatives of Mr. Man were present at the trial. One of them was the defendant’s grandson, who was also the victim’s son. He stood before the panel of judges and stated that his parents divorced and he was raised by his grandparents since he was a child. When the incident occurred, he was working.

"I tried to advise my father many times but to no avail. I witnessed my father beating my grandparents many times but could not stop him.My father used drugs so my grandfather's defense was justified," said the victim Luc's son.

As the representative of the victim, he asked the court to exempt his grandfather from criminal prosecution.

The other relative testified that Luc used drugs and was physically weak. "A couple of times a month, Mr. Man's wife called me to come and stop him because she was afraid that Luc would beat her to death. Every time he asked his parents for money and couldn't get it, Luc beat the two old people," this person testified.

The panel of judges determined that Mr. Man was sincere, had a good personal history, was 70 years old, came from a poor family, committed the crime for the first time, had many mitigating circumstances... so they sentenced him to 12 months of suspended imprisonment.
