Provincial Party Secretary and Chairman are not allowed to have guards.

The Law on Security Guards, just announced this afternoon, does not add any additional subjects that are allowed to have security guards as some opinions previously proposed that provincial secretaries and chairmen should have security guards.

Senior Lieutenant General Le Quy Vuong - Deputy Minister of Public Security said that Chapter 2 of the law stipulates the subjects of protection, measures and protection regime, including 6 articles from Article 10 to Article 15.

Accordingly, the subjects of protection, measures and protection regimes apply to people holding high-ranking positions and titles of the Party, State and the Central Committee of the Vietnam Fatherland Front.

In addition, international visitors and workers in Vietnam are also subject to security measures and regimes. Security measures are also applied to key areas and particularly important events.

“The regulations on guard subjects and measures on regimes stipulated in this chapter basically inherit the regulations of the 2005 Guard Ordinance. Accordingly, there are no additional guard subjects,” said the Deputy Minister of Public Security.

He also informed that the new point in this chapter is that it specifically stipulates measures and protection regimes for each group of protection subjects to facilitate the implementation process.

Previously, when discussing this law at the National Assembly, some opinions were concerned about the safety of the provincial party secretary and chairman after some unfortunate incidents recently occurred, so they proposed expanding the group of people who are allowed to have guards, including the provincial party secretary and chairman.

Fire is allowed in 4 cases

Regarding regulations on shooting while on duty, the Guard Law stipulates that guards are allowed to shoot in four cases.

Specifically, firing a gun in case of warning a subject who is breaking into a guarded area or target; firing a gun at a subject who is breaking into a guarded area or target, after giving a signal to stop and firing into the air but without effect; neutralizing a subject who is directly attacking a guard or guard officer or soldier on duty.

In addition, security officers and soldiers are allowed to shoot in other shooting cases according to the provisions of the law on management and use of weapons, explosives and supporting tools.

Also this afternoon, the Law on Management and Use of Weapons, Explosives and Support Tools was announced.

Accordingly, the law adds subjects equipped with weapons including the coast guard, cryptography, and the investigation agency of the Supreme People's Procuracy to meet practical requirements and ensure conditions for these forces to perform their assigned functions and tasks.

The Law assigns the Minister of National Defense and the Minister of Public Security to prescribe the provision of weapons to subjects under their management based on the nature, requirements, and tasks.

Both laws take effect from July 1, 2018.
