Chairman of Nghe An Provincial People's Committee requested strict handling of officials who violated regulations in Dien Chau

Many generations of commune chairmen have committed violations.

Recently, many people in Dien Yen commune (Dien Chau) have sent petitions to all levels to denounce Mr. Dinh Xuan Loc - former cadastral officer and leader of Dien Yen commune for selling land, legalizing land against the law and some other violations. This case has been investigated and concluded by the People's Committee of Dien Chau district, but citizens disagree, claiming that there is a cover-up for the wrongdoers.

On that basis, the Chairman of the Provincial People's Committee assigned the Provincial Inspectorate to establish an interdisciplinary working group to inspect and review 4 accusations: Dien Yen Commune People's Committee created a fake dossier to sell land managed by Yen Ly Dong Cooperative in the Quan Lu pond area, an area of ​​94,016m2, into 5% land to hand over to the enterprise; The Commune People's Committee did not collect into the budget the compensation money of the clean water plant project of nearly 1.7 billion VND, the Yen Ly overpass project of 451,313 million VND; Used 500 million VND of the province's support to renovate traffic roads; Settled the traffic road project without deducting 100 tons of cement from the New Rural Construction Program.

Regarding the land in the Quan Lu pond area, Mr. Le Van Hue - former Chairman of the Yen Ly Dong Commune Veterans Association; Mr. Le Van Thao - former Chairman of the Dien Yen Commune Veterans Association both said that the land in this area belongs to the cooperative, not the 5% land of the Dien Yen Commune People's Committee. After examining the records and collecting opinions from relevant organizations and individuals, the Provincial Inspectorate concluded that the citizen's accusation was wrong and based on Decree 64/CP in 1993 and the Land Law in 2013, there were no records or documents proving that the Quan Lu pond area was the land of the Yen Ly Dong Commune.

However, the People's Committee of Dien Yen commune put land plot No. 367, map sheet 111-62 with an area of ​​1,808m2 (the inventory book shows that the user is Nguyen Vang, the land use right certificate book shows that Nguyen Vang is the user) into public land is not in accordance with regulations.

People also accused the People's Committee of Dien Yen commune of not collecting compensation for the clean water plant project of nearly 1.7 billion VND and the Yen Ly overpass project of 451,313 million VND. The accusations are both true and false.

The accusation is true that the amount of 451,313 million VND that the Commune People's Committee did not pay into the commune budget but into a deposit account opened at the Dien Chau Bank for Agriculture and Rural Development. Every year, Dien Yen Commune does not include it in the budget revenue and expenditure settlement report submitted to the People's Council for approval and does not submit it to the Finance and Planning Department for review, which is contrary to the provisions of the State Budget Law.

The amount of nearly 1.7 billion VND has been recorded by the Commune People's Committee as a source of revenue for the commune budget through the State Treasury and has been included in the revenue and expenditure settlement data for 2012 and 2014.

Previously, the People's Committee of Dien Chau district concluded that the People's Committee of Dien Yen commune established records for 3 households including: Mr. Trinh Hong Phong, hamlet 12 (Deputy Head of the Party Committee Inspection Committee in charge of hamlet 12); Ms. Nguyen Thi Huong, hamlet 12 (Hamlet Head); Mr. Pham Hong Ba (Vice Hamlet Head) to receive 334,785,000 VND in compensation and support for the wrong subjects, contrary to the provisions of the 2013 Land Law, Decree 47/2014/ND-CP regulating compensation, support, and resettlement when the State reclaims land.

The commune does not put this money into the budget, but deposits it into an account opened at the Dien Chau Bank for Agriculture and Rural Development to monitor revenue and expenditure for the commune's needs.

Regarding the content of the internal traffic road project from the Cultural House of Hamlet 11, Dien Yen Commune to the Dien Yen road to Dien Hai, the Commune People's Committee has adjusted 100 tons of cement from the new rural program and project to put into this project, but when settling the account, it was not deducted but settled for the contractor, which is a correct accusation.

This action of the People's Committee of Dien Yen commune violated Circular No. 19/2011/TT-BTC of the Ministry of Finance in 2011 regulating the settlement of completed projects funded by the State. However, the People's Committee of the commune later discovered and resolved the issue by requiring the contractor to return 100 tons of cement. This amount of cement was divided by the commune to 3 hamlets 1, 9 and 15 and traffic works were built from the cement source supported by the commune.

The provincial inspectorate concluded that the responsibility for the violations in budget revenue and expenditure belongs to Mr. Nguyen Dang Hoi - former Chairman of Dien Yen Commune People's Committee, who is responsible as a leader according to the provisions of Decree No. 157/2007 of the Government; and Ms. Duong Thi Huong - former commune accountant.

In addition, Mr. Duong Dang Hoang - Chairman of Dien Yen Commune People's Committee also has related responsibilities when receiving the handover of financial work on behalf of Mr. Hoi, he did not process and enter into the budget the remaining unspent amount from the 5% public land support money for Dien Yen Commune People's Committee when implementing the Yen Ly overpass project.

Regarding the violations in the settlement of the traffic project, the responsibility belongs to Mr. Nguyen Dang Hoi - former Chairman of the People's Committee of Dien Yen commune; Ms. Duong Thi Huong - former accountant of the commune. Mr. Duong Dang Hoang - Chairman of the People's Committee of Dien Yen commune must also be responsible for the delay in recovering the above 100 tons of cement.

In 2018, the State granted the People's Committee of Dien Yen commune VND 2,283,688,000 to pay households affected by storms and floods in 2016 and 2017.

However, the People's Committee of Dien Yen commune did not pay the full amount to the people, keeping more than 1.6 billion VND to pay salaries and allowances to officials. The People's Committee of Dien Chau district then had to issue a document requesting Dien Yen commune to urgently pay this amount to the people affected by natural disasters.

For violations related to land plot 367, the responsibility belongs to Mr. Dinh Xuan Loc - former cadastral officer of Dien Yen commune and Mr. Phan Thanh Son - former Chairman of Dien Yen commune People's Committee.

Based on the conclusion of the Provincial Inspectorate, the Chairman of the Provincial People's Committee assigned the Chairman of the Dien Chau District People's Committee to seriously review the public service responsibilities and take appropriate disciplinary action against the violations of the following persons: Mr. Duong Dang Hoang - Chairman of the Dien Yen Commune People's Committee; Ms. Duong Thi Huong - former commune accountant; Mr. Phan Thanh Son - former Chairman of the Dien Yen Commune People's Committee; Mr. Dinh Xuan Loc - former cadastral officer and related collectives and individuals whose public service responsibilities have not been considered.

At the same time, check and review the issuance of the Land Use Right Certificate for land plot No. 367, map sheet 111-62 with an area of ​​1,808m2 belonging to the user, Mr. Nguyen Vang. Because, through verifying the complaint, the above-mentioned shortcomings and limitations were discovered and the responsibility of the relevant collective and individuals if any violations were discovered was seriously reviewed.

The Chairman of the Provincial People's Committee also requested the Standing Committee of Dien Chau District Party Committee to direct disciplinary action against Mr. Nguyen Dang Hoi - former Chairman of Dien Yen Commune People's Committee, now Secretary of the Commune Party Committee and Party organizations and Party members under their authority.

Speaking to reporters, Mr. Tang Van Luyen - Chairman of Dien Chau District People's Committee said that after receiving the conclusion of the Chairman of the Provincial People's Committee, the district agreed to assign the District Party Committee's Inspection Committee to preside over and coordinate with departments and offices to take steps to review and propose a form of handling. After that, the District Party Committee and District People's Committee will meet and propose a form of handling for organizations and individuals with violations.
