(Baonghean.vn) - More than five years ago, the secondment policy under Article 36 of the Civil Servant Law was seen as a "lifeline" to promptly support teachers transferred to Education and Training Departments. However, the implementation of this secondment policy at the grassroots level has given rise to many shortcomings.

Part I: "Circumventing the law" to enjoy benefits

Taking advantage of Official Document No. 6612/UBND-TH dated September 24, 2012, which stipulates...Department of Education &TrainWith 4 to 8 seconded officials from district-level school units assigned to work in the department, many localities have "circumvented the law" by assigning long-serving officials to the department to benefit from policies that are not in accordance with regulations.

Teachers on secondment become "debtors".

This is the situation at the Education and Training Department of Con Cuong District, where the Provincial Party Committee's Inspection Commission is requesting the recovery of over 1 billion VND from 10 seconded teachers. This is considered a "last resort," but the recovery is necessary, given that many years ago, taking advantage of the secondment policy, numerous individuals in the Education and Training Department violated regulations. As a result, the issue remains very difficult to resolve completely to this day.

Previously, like many other Education and Training Departments, the Con Cuong District Education Department employed staff who served as both civil servants and public employees. The civil servants were primarily the head and deputy head of the department, and some staff members such as accountants and treasurers. The rest were public employees seconded from schools. Around 2012, the person seconded had over 20 years of experience. During this secondment period, these public employees, despite working in the department, did not receive the 25% civil servant allowance like other departments within the Committee. They also did not receive seniority allowances, teaching allowances, or other allowances like other teachers working in schools.
