(Baonghean.vn) - More than 5 years ago, the secondment policy under Article 36 of the Law on Civil Servants was considered a "lifesaver" to promptly support teachers who were transferred to work at the Departments of Education and Training. However, the implementation of the secondment policy at the grassroots level has encountered many shortcomings.

Part I: "Circumventing the law" to enjoy benefits

Taking advantage of Official Dispatch No. 6612/UBND-TH dated September 24, 2012, pEducation &TrainArranged from 4 to 8 officials seconded from school units in the district to work, many localities have "circumvented the law" by "on-site secondment" for officials who have worked for many years in the department to enjoy policies that are against regulations.

Seconded teachers become "debtors"

That is the incident that took place at the Department of Education and Training of Con Cuong district, the unit that is being requested by the inspection team of the Provincial Party Committee's Inspection Committee to recover more than 1 billion VND from 10 teachers on secondment at the department. This is also considered a "last resort" but the recovery is necessary, when many years ago, taking advantage of the secondment policy, many individuals at the Department of Education and Training violated regulations. As a result, up to this point... it is very difficult to resolve completely.

Previously, like many other Education & Training Departments, the Con Cuong District Education Department arranged staff to work as both civil servants and public employees. The civil servants were mainly heads and deputy heads of departments and some departments such as accountants and treasurers. The rest were officials transferred from schools. In 2012, the most transferred people had been working for over 20 years. During the transfer process, although the officials were working in the department, they did not receive the 25% civil servant allowance like other departments in the Committee. They also did not receive seniority allowances, class allowances or other allowances like other teachers working in schools.
