Song Lam Cement Joint Stock Company clarifies the incident of 180 drivers striking to protest Tet bonuses

(Baonghean.vn) - After the incident of 180 drivers going on strike against regulations, Song Lam Nghe An Cement Joint Stock Company worked with relevant parties and had a dialogue with the drivers to clarify the incident.

Regarding the drivers' strike to protest the company's Tet bonus policy, Song Lam Cement Joint Stock Company issued Official Dispatch No. 30/21/CV-VIS.SL (dated February 7, 2021) with the following clear response:

- Article 104 of the current Labor Code stipulates: “LettersliveBonus is the amount of money or property or in other forms that the employer rewards the employee based on the production and business results and the employee's level of work completion. The bonus regulations are decided by the employer and publicly announced at the workplace after consulting the opinion of the organization representing the employees at the workplace for places where there is an organization representing the employees at the workplace.”.

Thus, the payment of bonuses is decided by the employer based on the production and business results of the enterprise each year and is discussed and decided by the emulation and reward council. Different jobs have different bonus levels; different units have different bonus levels and different individuals with different work achievements will also have different bonus levels... to ensure fairness for employees.

The above document also clearly states: In the bonus payment plan of The Vissai Cement Group issued in Document No. 01/2021/KHTK-BTCHC dated January 30, 2021 applicable to the entire Group, it is stipulated that:

+ Indirect block bonus according to basic salary (according to decision). And basic salary is clearly defined for FC fleet (in Section 3) Submission No. 12/15/TTr-VT dated December 1, 2015 approved by the Chairman of the Group as: 250,000 VND/working day.

Therefore, the FC team's bonus is calculated as follows: 250,000 VND x 30 days x 200% = 15,000,000 VND

+ Bonuses are based on the achievements of each individual and unit.

At point 2, Section I of Plan No. 01/2021/KHTK-BTCHC dated January 30, 2021, it is stipulated as follows:“For departments and divisions with individuals who: have serious accidents, steal property, gamble... negatively affecting the company, the entire department and division will only receive a bonus of 200% of the average salary in 2020 x 80% of the benefit level”.

This is a general regulation applied to all departments, divisions, and divisions to promote all employees to support each other in their work, helping the entire system operate completely, aiming at the goal of the company's comprehensive development. The above regulation is not against the law.

Because in the past year, there was an employee in the FC fleet who stole company property, applying the above regulation, the bonus for the FC fleet will be: 250,000 VND x 30 days x 200% x 80% = 12,000,000 VND. That is the highest level for employees who complete their tasks well in the fleet. Those who do not have enough working days or volume will be deducted according to the prescribed levels. Thus, the company is applying the bonus payment for FC team employees in accordance with the Group's regulations and in accordance with current laws.

At the dialogue between the Board of Directors of Song Lam Cement Joint Stock Company and FC fleet employees, there were some recommendations on some of the regulations for FC fleet: the fault of causing traffic accidents on the road due to objective and subjective reasons of employees.

The company leader said: In fact, the company has supported the workers to resolve the above errors, and there has never been a case where the workers have resolved them themselves. This is just a false argument of some troublemakers, aiming to divide the workers from the company.

Some suggestions to increase the salary for drivers, the company's leaders said that, in fact, the monthly salary of drivers is much higher than the regional minimum wage regulated by the Government. However, this opinion will be considered by the company's leaders based on production and business efficiency.

Therefore, Song Lam Cement Joint Stock Company requests FC fleet employees to comply with the law, return to work immediately to ensure their rights, and absolutely not let bad people lure them into affecting themselves and their families.

Considering the reason this time due to lack of understanding, the FC team acted arbitrarily and stopped working without permission, the company's Board of Directors should consider and create favorable conditions for honest and disciplined workers. Hopefully this will be the last time this happens. If it happens again, the company's Board of Directors will coordinate with the authorities to resolutely handle it according to the provisions of the law.

After the incidentillegal strike, Song Lam Nghe An Cement Joint Stock Company has decided to terminate the contracts of 15 FC drivers who have behaved inappropriately and enticed other employees to act inappropriately. By the morning of February 9, 2021, 120 drivers had returned to work. If some other drivers do not return to work after February 9, 2021, the Company will handle them in accordance with current laws.
