Specifically, Document No. 4602/STNMT-QLDD of the Department of Natural Resources and Environment has the following content: Implementing the tasks assigned by the Provincial People's Committee in Notice No. 187/TB-UBND dated March 31, 2016 of the Provincial People's Committee on the conclusion of the Vice Chairman of the Provincial People's Committee at the working session with relevant sectors and localities on the rubber planting project in Nghe An invested by Nghe An Rubber Development Investment Joint Stock Company; based on the opinion of the People's Committee of Que Phong district in Report No. 206/BC-UBND dated June 22, 2020 reporting the results of reviewing projects that are behind schedule and not implemented in Que Phong district. After consideration, based on current regulations, the Department of Natural Resources and Environment has the following opinions:
The rubber tree planting project of Nghe An Rubber Development Investment Joint Stock Company has been approved by the Provincial People's Committee.planningin Decisions No. 1708/QD-UBND.NN dated April 29, 2009; No. 5990/QD-UBND dated November 11, 2009; No. 5334/QD-UBND dated December 6, 2011 and No. 4081/QD-UBND dated September 13, 2013 in the area of 3 districts Anh Son, Thanh Chuong, Que Phong, with an area of 10,759.6 hectares.
However, through reviewing the land allocation and land lease records kept at the Department of Natural Resources and Environment, it shows that, up to now, Nghe An Rubber Development Investment Joint Stock Company has not yet prepared a record to carry out land allocation and land lease procedures to implement the project.invest in rubber plantingaccording to the provisions of the 2013 Land Law. Therefore, the Department of Natural Resources and Environment requests Nghe An Rubber Development Investment Joint Stock Company to report on the company's land use situation in each district, specifically: Planning area approved by the Provincial People's Committee; area put into use; time of land use for the area put into use.

Regarding the content of handling land lease dossiers of Nghe An Rubber Development Investment Joint Stock Company in Thanh Chuong district, due to the handling of public assets, the Department of Natural Resources and Environment reported to the Provincial People's Committee in Official Dispatch No. 2802/STNMT-QLDD dated June 16, 2020. Therefore, in order to have a basis for synthesizing and reporting to the Provincial People's Committee to handle all planning areas for the company in Anh Son, Thanh Chuong, Que Phong districts, Nghe An Rubber Development Investment Joint Stock Company is requested to report the area of public assets within the planning area to implement the rubber tree planting project of Nghe An Rubber Development Investment Joint Stock Company (land of the Youth Union 2-XDKT, Anh Son Forestry Company, Que Phong Forestry Farm, Song Hieu Forestry One Member Co., Ltd., Que Phong Protective Forest Management Board...). Conducting the compilation and measurement of the area put into use as a basis for makingland lease records, issue Land Use Rights Certificate according to regulations.

On the same day, September 10, 2020, the Department of Natural Resources and Environment issued Document No. 4600 /STNMT-QLDD on adjusting the rubber tree planning of Nghe An Rubber Development Investment Joint Stock Company in Que Phong district to the Provincial People's Committee.

Here, the Department of Natural Resources and Environment reported to the Provincial People's Committee the results of the review conducted by the District People's Committee.Que Phongimplemented for projects that are behind schedule and not implemented in the area (according to Report No. 206/BC-UBND dated June 22, 2020 of Que Phong District People's Committee); the Nghe An Newspaper issue dated September 3, 2020 published the article: "Thousands of hectares of rubber trees, enterprises still "have not" been able to rent land" related to the overlapping of rubber planting planning in Que Phong district.
Specifically, the rubber tree planting project of Nghe An Rubber Development Investment Joint Stock Company in Que Phong district was approved by the Provincial People's Committee with an area of 3,089 hectares. However, the above planning still has some shortcomings and problems, such as: The planning overlaps with the Chau Thang Hydropower project, the Hua Na Hydropower resettlement area; the planning overlaps with the land area that the Provincial People's Committee has recovered from Que Phong Forestry Enterprise and assigned to the locality for management with an area of about 1,045.8 hectares; the planning is not suitable for local reality such as being too close to residential areas, river and stream sources; rubber planting overlaps with the communal land of Pom Om village (Hanh Dich commune); there are about 519 hectares planned for rubber planting in natural forests in Tien Phong commune that overlap with the plan.forest allocationassociated with the allocation of forestry land to households, individuals, and communities of Tien Phong commune according to the project approved by the Provincial People's Committee in Decision No. 4213/QD-UBND dated September 20, 2018.

According toDepartment of Natural Resources and Environment, regarding the content of handling overlapping rubber planting planning in Que Phong district, the Provincial People's Committee has issued the following Notices: No. 187/TB-UBND dated March 31, 2016 of the Provincial People's Committee on the conclusion of the Vice Chairman of the Provincial People's Committee at the working session with relevant sectors and localities on the Rubber Planting Project in Nghe An invested by Nghe An Rubber Development Investment Joint Stock Company; No. 1851/UBND-TH dated March 26, 2019 on the implementation of the Notice of Conclusion of the Standing Deputy Secretary of the Provincial Party Committee at the working session with the Standing Committee of Que Phong District Party Committee, in which, the Provincial People's Committee assigned the Department of Agriculture and Rural Development to preside over and coordinate with relevant agencies and localities to specifically consider and advise the Provincial People's Committee to decide on a handling plan.
In addition, for content related to the reflection ofvotersQue Phong district related to land encroachment of Nghe An Rubber Development Investment Joint Stock Company transferred by the Provincial National Assembly Delegation, assigned by the Provincial People's Committee in Official Dispatch No. 5126/UBND-TH dated August 4, 2020, the Department of Natural Resources and Environment issued Official Dispatch No. 3917/STNMT-QLDD dated August 10, 2020 to report to the Provincial People's Committee.
Therefore, the Department of Natural Resources and Environment proposed that the Provincial People's Committee continue to assign the Department of Agriculture and Rural Development to preside over reviewing, reporting, and advising the Provincial People's Committee to handle and adjust the rubber tree planting plan of Nghe An Rubber Development Investment Joint Stock Company to respond to voters' petitions and press reports in accordance with regulations.
