Proposal to reduce one vice chairman of the district People's Council

Commenting on the Law on Organization of Local Government, Deputy Head of the Provincial People's Council's Legal Committee Tran Dinh Toan proposed reducing the number of People's Council delegates for those who have held positions in administrative agencies (directors of departments, chairmen of districts, cities, and towns).
"It is proposed to increase the number of full-time People's Council delegates at the provincial level, reduce the number of vice chairmen of the district-level People's Council from 2 to 1 person; the number of People's Council delegates at the commune level should be reduced because practical results show that the role, function, supervision and criticism of the commune-level People's Council are not effective" - Mr. Tran Dinh Toan said.

Vice Chairwoman of Nam Dan District People's Council Nguyen Thi Hien expressed her opinion: Based on local reality, the district level should arrange 1 Vice Chairman of the People's Committee in charge of the economic sector to increase authority, responsibility and efficiency; instead of the current arrangement of 3 Vice Chairmen, including 2 Vice Chairmen in charge of the economic sector and 1 Vice Chairman in charge of the social and cultural sector.
For the district-level People's Council, there should be a Vice Chairman. Along with that, the heads of the district-level People's Council committees must be full-time to facilitate and increase the effectiveness of the district-level People's Council's operations.
Regarding the provisions on decentralization and delegation of power in the Law on Organization of Local Government, Mr. Nguyen Ho Canh - Legal collaborator of the Provincial National Assembly Delegation said: In reality, many violations aimed at circumventing the law and decentralization such as the authority to approve, appoint contractors for basic construction works, enrollment, recruitment, testing, selection, emulation, rewards, discipline... have been and are taking place quite commonly.
"Therefore, the Law needs to be amended to overcome the limitations of the current law, focusing on decentralization and delegation of power associated with the development and implementation of inspection, supervision and sanction mechanisms," said Mr. Canh.

At the conference, the delegates also suggested keeping the two full-time vice chairmen of the provincial People's Council (if the Chairman of the provincial People's Council is concurrent); not reducing the number of full-time deputy heads of provincial and district-level committees; stipulating that the head of the district-level People's Council must be full-time; the number of delegates should be based on the population; the name of the "extraordinary" session should not be used.
Delegates suggested that the role of the People's Council at the commune level should be re-evaluated. Many suggested that the model of the People's Council at the commune level should be abolished because in reality, the People's Council at the commune level does not have the authority to issue policies and mechanisms and operates ineffectively...
Regarding the merger of the Office of the National Assembly Delegation, the People's Council and the Provincial People's Committee, the majority of delegates suggested merging the Office of the National Assembly Delegation and the Office of the Provincial People's Council, while the Office of the Provincial People's Committee should operate independently to avoid overlap.

Appreciating the responsible and intelligent comments of the delegates, Deputy Head of the Provincial National Assembly Delegation Nguyen Thanh Hien emphasized: The amendment and supplementation of the law this time comes after the Central Resolutions on streamlining the apparatus, while overcoming the limitations of the current law.
The comments of the delegates will be compiled by the Office of the Provincial National Assembly Delegation and sent to the National Assembly Standing Committee.
