Proposal to increase full-time National Assembly deputies to 200 people

One of the two options stipulates that the proportion of full-time National Assembly deputies is at least 40% of the total number of National Assembly deputies (equivalent to 200 people).

On the morning of February 11, the National Assembly Standing Committee discussed major issues with different opinions on the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly.

The National Assembly may increase to 200 full-time delegates.

Chairman of the Law Committee Hoang Thanh Tung said that regarding the proportion of full-time National Assembly deputies, besides many opinions agreeing with the current regulation of at least 35% of the total number of National Assembly deputies, there are also many opinions suggesting raising this proportion to 37%, 40% of the total number of National Assembly deputies or even higher.

The Standing Committee of the Law Committee and the Drafting Committee would like to present two options for comments. Accordingly, Option 1 maintains the regulation on the proportion of full-time National Assembly deputies being at least 35% of the total number of National Assembly deputies (equivalent to about 175 deputies) as in the current Law on Organization of the National Assembly. This is also the option that the Standing Committee of the Law Committee agrees with.

Option 2 stipulates that the proportion of full-time National Assembly deputies is at least 40% of the total number of National Assembly deputies (equivalent to about 200 deputies).

Regarding the structure of National Assembly deputies, Mr. Hoang Thanh Tung also said that there are opinions suggesting that there should be a policy to attract cadres, civil servants, and public employees with many years of working experience, capacity, intelligence, who are close to retirement age or have retired but still meet health requirements to participate as full-time National Assembly deputies; not to control the maximum age of National Assembly deputies or to extend the working age of full-time National Assembly deputies to a higher level (65-67 years old) than the provisions of the Labor Code to maximize the intelligence and experience of deputies.

The Standing Committee of the Law Committee and the Drafting Committee consider this a highly positive proposal that should be considered. However, according to current legal regulations, full-time National Assembly deputies are cadre positions, subject to the Law on Cadres and Civil Servants, so if there are separate regulations on working age for National Assembly deputies, they should be calculated and reflected in the Law on Organization of the National Assembly.

Suggestion2 Committees of specialized agencies of the National Assembly

The report of the Law Committee shows that many opinions suggest studying and fully evaluating to convert the Delegation Work Committee and the People's Petition Committee into specialized agencies (Committees) under the National Assembly to ensure uniformity in organizational forms and specialization requirements for the advisory and support apparatus of the National Assembly. However, there are also opinions that do not agree with upgrading these Committees into agencies under the National Assembly because there is not enough argument about the necessity.

Currently, the Delegation Work Committee and the People's Petition Committee have submitted a Project to the National Assembly Standing Committee to transform them into specialized agencies and propose to supplement the Law on Organization of the National Assembly with regulations on the legal status, functions, tasks, and powers of these agencies.

Accordingly, the Organizing Committee for Elected Delegates (based on the Delegation Work Committee) is a specialized agency of the National Assembly, with the function of advising and assisting the National Assembly, directly and regularly the National Assembly Standing Committee, on the work of elected representatives and the organization of the apparatus and personnel of the National Assembly, the National Assembly Standing Committee, the Ethnic Council and the National Assembly Committees, agencies under the National Assembly, the National Assembly Standing Committee and the People's Councils according to the provisions of law.

The People's Petition Committee is a specialized agency of the National Assembly, with the function of advising and assisting the National Assembly and the National Assembly Standing Committee on people's petition work.

Speaking at the discussion session, Ms. Nguyen Thanh Hai - Head of the People's Petition Committee mentioned the political, legal and practical basis of the above proposal, and said that after being consulted, 61 delegations also agreed with the project.
