(Baonghean.vn) - The National Assembly delegation of Nghe An province has made many additional contributions to the Draft Law on Residence (amended) to create the most favorable conditions for citizens when carrying out administrative procedures.
October 21 - the second working day of the 10th session of the 14th National Assembly. Under the direction of Vice Chairman of the National Assembly Uong Chu Luu, the National Assembly considered and gave opinions on two draft laws: DraftLaw of Residence(amended) and DraftBorder LawVietnam.

Discussing the Draft Law on Residence (amended), delegates agreed to report, accept and revise the Draft Law on Residence (amended).
To clarify and perfect the content of the draft Law, creating the most favorable conditions for people when carrying out administrative procedures, the opinions of the delegates suggested that the drafting committee should clearly explain the terms and clarify the concepts of permanent residence and temporary residence.
It is necessary to specify more clearly the conditions for permanent residence registration; the responsibility of state management in residence management; supplement the responsibility of ward and commune police, households, and labor employing agencies...
The draft Law on Residence (amended) was discussed and commented on by National Assembly deputies at the 9th session of the 14th National Assembly; the National Assembly Standing Committee commented at the 47th session. After receiving and revising, the draft Law consists of 7 chapters and 38 articles, including a number of major issues.
The National Assembly delegation of Nghe An province has made many additional contributions to the content of the Draft.Law of Residence(modify).
Specifically, regarding the conditions for temporary residence registration in Article 20, Point a, Clause 3 of this Article, it is recommended that the condition for temporary residence registration should not be agreed by the lessor, lender, or host because this provision hinders citizens' right to register their residence and negatively affects the residence management work of State agencies.
It is proposed to add content on temporary residence registration conditions for "In case the temporary residence registrant is under 18 years old, it is required to have the opinion of the guardian or have a document proving the family relationship between the head of household and the temporary residence registrant".

Regarding the cancellation of permanent residence registration in Article 24: It is recommended that consideration be given to the regulation of this case of cancellation of permanent residence registration to limit the cases of Vietnamese citizens who are sentenced to a fixed-term imprisonment and, after serving their sentence, reintegrate into the community without a permanent residence. The regulation of cancellation of permanent residence registration in this case will directly affect a large number of Vietnamese citizens who are working or studying abroad but still have permanent residence registration, legal accommodation and Vietnamese nationality before the Law on Residence (amended) takes effect.
Regarding the deletion of permanent residence registration in Article 24, the draft law adds that in case of deletion of permanent residence registration in case of absence of 12 consecutive months or more, there must be additional provisions to restore the deleted permanent residence registration to ensure the residence rights of Vietnamese citizens protected by the Constitution and the Law on Residence.
The Nghe An National Assembly delegation proposed to continue to regulate the temporary residence registration period as the current Law, which is a maximum of 2 years, to distinguish it from permanent residence registration.

Affirming that the Draft Law on Residence (amended) replaces the management of residence (permanent residence, temporary residence) from manual method using paper books to management method using information technology, using personal identification codes including information related to personal identity, which is suitable to the requirements in the new situation.
However, the National Assembly Delegation of Nghe An proposed to have separate transitional regulations on this issue and it is necessary to calculate a specific roadmap for synchronous implementation nationwide, during which it is necessary to continue using Household Registration Books and Temporary Residence Books.
