(Baonghean.vn) - Basically agreeing with the promulgation of the Law on Support for Small and Medium Enterprises, however, most comments said that this draft law is still sketchy, general, vague, and does not meet the requirements.
Commenting on the draft law, Mr. Ha Le Dung - Deputy Director of Nghe An Tax Department expressed concern about the name of the law "Support for small and medium enterprises" because if it supports, it will violate the law on competition when our country participates in international economic integration. Regarding the content, Mr. Dung assessed that the draft law has many issues to support but "reading and re-reading" has not seen any support?
“Korea has a law that says ‘big businesses cannot do small things’ and then details the small things big businesses cannot do. We have to think of ways to make a living and create jobs for them,” Mr. Dung suggested.

Mr. Pham Dinh Ngan - representative of the Vietnam Chamber of Commerce and Industry, Nghe An branch (VCCI Nghe An) expressed concern that Vietnam wants to create an equal business environment, but will this law intervene and support small and medium enterprises, which will distort the market?
Mr. Ngan also said that the beneficiaries are small and medium-sized enterprises, but the criteria for classifying the scale of these enterprises depends on many criteria and business types such as manufacturing or services, so the law must clearly define the criteria to avoid the "request - give" mechanism when determining the scale of enterprises.
The representative of VCCI Nghe An also assessed: "The draft law still has many general, vague, and unspecific points, for example, what the measures to support access to credit are, how they are operated, and where they come from."

Supporting businesses is an issue raised by Mr. Nguyen Van Hai - Deputy Director of the Provincial Investment Promotion and Investment Support Center in his speech. He said that the support resources include 3 main sources: budget, credit from the budget and socialized sources, but in reality in Nghe An, the main support resources for training and scientific and technological innovation are mainly from the budget... Therefore, it is necessary to consider because when issued, it will become a burden on the state budget.
Meanwhile, according to Mr. Hai, the draft law stipulates a Credit Guarantee Fund for Small and Medium Enterprises to support businesses, but the Credit Guarantee Fund has only been established at the central level, while in localities it is difficult to establish, some localities can establish it, some provinces cannot. Therefore, "the credit guarantee fund at the central level should be re-evaluated before introducing provisions on credit guarantees into the law" - Mr. Hai proposed.

Also at the conference, many comments on the draft law said that the provisions on tax support, production premises, incubation and technological capacity improvement... are still general and need to be specific and clear.
Receiving the opinions of the delegates and chairing the meeting, Deputy Head of the Provincial National Assembly Delegation Nguyen Thanh Hien assessed that the opinions contributed to the draft law were complete, responsible, had many contents and basically agreed with the necessity of promulgating this law.
Mr. Hien also accepted the opinions that the content of the draft law is still sketchy, does not meet the requirements, the law is built in the form of specifying each clause, not building a framework law to avoid the situation of waiting for guiding decrees of the Government, ministries, branches, the law is slow to come into life when promulgated.
The Draft Law on Supporting Small and Medium Enterprises has 4 chapters and 38 articles. This is a draft law considered very important for business development in our country as it has an impact on small and medium enterprises, which account for about 97% of enterprises nationwide. |
The Deputy Head of the Provincial National Assembly Delegation also emphasized the viewpoint of the 14th National Assembly that the law making is not focused on framework laws but on specifics. The Government must submit a draft decree to the National Assembly. "The National Assembly Standing Committee's attitude is very clear that if any law is not good, it will not be introduced or submitted," Mr. Hien emphasized.
Mr. Nguyen Thanh Hien also said that after the conference to collect opinions from state management agencies, the Office of the Provincial National Assembly Delegation will organize a conference to collect opinions from businesses on the draft Law on Support for Small and Medium Enterprises; at the same time, meet with voters who are businesses in the province.
