Plan to assign teachers who fail to meet standards for 2 consecutive years to other jobs

The Ministry of Education and Training has just announced a draft Circular regulating the use of teachers and managers of preschool, primary and secondary schools who do not meet the standard training level.

If approved and promulgated, this Circular will regulate the use of teachers and managers of preschool, primary and secondary education facilities who do not meet the training standards prescribed in Point a and Point b, Clause 1, Article 72 of the Law on Education.

Point a and point b, Clause 1, Article 72 of the Law on Education:

1. The standard training level of teachers is specified as follows:

a) Have a college degree in pedagogy or higher for preschool teachers;

b) Have a bachelor's degree or higher in teacher training for primary, middle and high school teachers.

In case the subject does not have enough teachers with a bachelor's degree in teacher training, they must have a bachelor's degree in a relevant major and a certificate of pedagogical training.

This content is expected to apply to teachers and staff who have not met the standard qualifications but are not subject to the standard upgrading roadmap and are trained according to regulations in preschool education institutions; primary schools, secondary schools, general schools with multiple levels including primary or secondary school; specialized schools, other educational institutions implementing general education programs at primary and secondary school levels; continuing education centers, vocational education - continuing education centers implementing general education programs at secondary school level.

According to the draft circular, ifteacher for 2 consecutive yearsadjacent to the year this circular takes effect, with assessment results, classification meeting professional standards or higher, or classified, civil servants assessed as completing tasks or higher, and having good health, will continue to be assigned to teaching work until retirement according to regulations.

However, in case of 2 consecutive years of assessment and classification results that do not meet professional standards and 1 year of classification and evaluation of civil servants as not completing their tasks, they will not be assigned to teach and will be arranged to participate in professional training to be assigned to another suitable job position until retirement according to regulations.

Teachers who are not healthy enough, wish to retire, and meet all the conditions prescribed by the Law on Social Insurance shall be allowed to retire according to regulations.

For educational institution managersAccording to the draft circular, if for 2 consecutive years, a person is classified as meeting the standards of a principal or higher, or is classified and evaluated as a civil servant or public employee as having completed his/her duties or higher, and is in good health, he/she will continue to hold the position of school manager until the end of the term of appointment. After the end of the term, the school manager position will not be reappointed but will be assigned to another suitable position until retirement according to regulations.

However, in case the evaluation and classification results do not meet the standards of a principal and for 1 year the civil servant or public employee is classified as not completing his/her duties, he/she will be removed from the position of school manager and assigned to teaching duties or arranged to participate in professional training to be assigned to another suitable job position.

Educational institution managers who are not healthy enough and wish to retire and meet all conditions prescribed by the Law on Social Insurance shall be eligible to retire according to regulations.

The draft was solicited for comments by the Ministry of Education and Training from May 22 to July 22.
