Businesses that force employees to work during the April 30 - May 1 holidays can be fined up to 50 million VND.

According to Article 115 of the 2012 Labor Code, each year, employees have 6 holidays and Tet holidays to take time off and receive full pay: New Year's Day; Lunar New Year; Victory Day (April 30); International Labor Day (May 1); National Day (September 2); Hung King's Commemoration Day (March 10 of the lunar calendar).

If the enterprise wants employees to work on these days, it must have their consent and must pay them at least 300% more salary (Point c, Clause 1, Article 97 of the 2012 Labor Code).

Holidays are one of the legitimate rights of employees recognized and protected by law. In case an enterprise forces employees to work without their consent, it will be considered a violation of the law and will be handled appropriately. Specifically:

- Fine up to 1 million VND for violations involving 1 to 10 employees;

- Fine up to 3 million VND if violating with 11 to 50 employees;

- Fine up to 7 million VND if violating with 51 to 100 employees;

- Fine up to 10 million VND if violating with 101 to 300 workers;

- Fine up to 15 million VND if violating with 301 or more employees;

- Fine up to 50 million VND if forcing employees to work overtime exceeding 12 hours/day.

In addition, businesses that force employees to work overtime exceeding 12 hours/day during holidays will have their operations suspended for 1 to 3 months.
