According to the indictment: Ha Van Dung and Sam Van Le (Chau Quang commune) are both drug addicts. At around 7:20 p.m. on February 6, 2018, while Dung was cooking at his home in Yen Luom hamlet (Chau Quang), Le came to Dung's house and gave him 200,000 VND to buy a package of drugs.
After 15 minutes, Dung went into the house and took out from his right pocket a package of heroin wrapped in a piece of white polyethylene, then used a razor blade to cut a small package weighing 0.03g and gave it to Le.
When he had just delivered the drugs to Le, Dung discovered that there were police officers, so he took the remaining package of drugs and ran behind the house and threw it into the sugarcane field in an attempt to hide the evidence. However, using professional measures, Quy Hop Police conducted a search and seized the package of drugs that Dung had hidden in the sugarcane field. The total amount of drugs that Quy Hop Police seized from Ha Van Dung was 1.585 grams of heroin and 200,000 VND in cash.
At the investigation agency, Dung stated that the drugs sold to Le were purchased from an unknown man in Tuong Duong district in January 2018 for 1.3 million VND with the purpose of using and dividing them into small amounts to sell for profit.
Based on the evidence and documents examined; based on the results of the debate at the trial, the panel sentenced Ha Van Dung to 2 years in prison for the crime of "Illegal drug trafficking" under Clause 1, Article 251, Penal Code 2015.
As for the man who sold drugs to Ha Van Dung, the investigation could not determine his name, age, or address, so the investigation agency had no basis to prosecute him criminally. As for Sam Van Le, because the drug package did not weigh enough to prosecute him criminally, the investigation agency decided to impose an administrative penalty.
