Being beaten, Hung ran into the coffee shop. Hien and Bang chased after him and continued to beat him, causing him to fall down. Dinh Van Tuan put a gun to Hung's head and pulled the trigger. The bullet hit Hung behind the ear, injuring the victim. Tuan, Hien and Bang fled. A day later, the group went to the police to surrender.
Mr. Hung was injured and taken to the hospital for emergency treatment. The victim's disability rate was assessed at 10%. The forensic conclusion of the Criminal Techniques Department of Nghe An Province Police showed that the gun seized from Dinh Van Tuan was a homemade revolver, firing sports bullets, and had the same function as a military weapon.
Dinh Van Tuan was prosecuted for “Murder” and “Illegal possession of military weapons”. Hoang Van Hien was prosecuted for “Murder”.
At the trial, the defendants confessed their crimes. The victim also filed a petition for a reduced sentence for Tuan and Hien.
Considering the aggravating and mitigating circumstances, the panel sentenced Dinh Van Tuan to 5 years in prison for “Murder” and 1 year in prison for “Illegal possession of military weapons”. Hoang Van Hien was sentenced to 2 years in prison for “Murder”.
The investigation agency determined that Ho Sy Bang was not an accomplice with Tuan and Hien in the act of "Murder", so Bang was administratively punished for disturbing public order.
In civil matters, the parties involved have reached an agreement so the court will not consider it./.
