Perfecting the legal system and the mechanism for organizing strict and consistent law enforcement

On the morning of December 5, the Politburo and the Secretariat held a nationwide in-person and online conference to study and disseminate the Resolution of the 6th Central Conference, 13th tenure of the Party.

At the Dien Hong Hall, National Assembly House, Hanoi, the conference was attended by comrades: Pham Minh Chinh - Politburo member, Prime Minister; Nguyen Sinh Hung - former Politburo member, former Chairman of the National Assembly; Nguyen Thi Kim Ngan - former Politburo member, former Chairman of the National Assembly; Vo Van Thuong - Politburo member, Standing member of the Secretariat and co-members of the Politburo, members of the Secretariat, members of the Party Central Committee; leaders of central departments, ministries, branches, mass organizations, and Party Committees directly under the Central Committee.

On the morning of December 5, the Conference listened to Comrade Phan Dinh Trac - Politburo member, Secretary of the Party Central Committee, Head of the Central Internal Affairs Commission convey Resolution No. 27-NQ/TW dated November 9, 2022 of the Party Central Committee, 13th tenure on "Continuing to build and perfect the socialist rule-of-law State of Vietnam in the new period".

Accordingly, Resolution No. 27 raises five viewpoints; at the same time, it has a general goal: Perfecting the Vietnamese socialist rule-of-law State of the people, by the people, for the people, led by the Communist Party of Vietnam; having a complete legal system, strictly and consistently implemented; upholding the Constitution and laws, respecting, ensuring and effectively protecting human rights and citizens' rights; State power is unified, clearly assigned, closely coordinated and effectively controlled; professional, rule-of-law and modern administration and judiciary; a streamlined, clean, effective and efficient State apparatus; a contingent of cadres, civil servants and public employees with adequate qualities and capacity, truly professional and honest; modern and effective national governance; meeting the requirements of rapid and sustainable national development, becoming a developed, high-income country with a socialist orientation by 2045.

The Resolution has five specific goals by 2030, focusing on: Perfecting the legal system and the mechanism for strict and consistent law enforcement; ensuring respect for the Constitution and the law; and improving the quality of legal human resources.

Perfecting the mechanism for controlling State power, promoting the prevention and fight against corruption and negativity; continuing to promote administrative reform, enhancing decentralization, clarifying the functions, tasks and powers of organizations and individuals in the State apparatus while improving enforcement capacity; building a streamlined State apparatus that operates effectively and efficiently. Promoting judicial reform, ensuring the independence of the court according to its jurisdiction, judges and jurors adjudicating independently and in accordance with the law.

Resolution No. 27 sets out 10 groups of tasks and solutions, including: Strengthening propaganda, dissemination, education, and raising awareness of the Socialist Republic of Vietnam's rule of law; Ensuring the people's right to mastery, upholding the Constitution and laws, respecting, ensuring and protecting human rights and citizens' rights; Continuing to perfect the legal system and the mechanism for organizing strict and effective law implementation, ensuring the requirements of rapid and sustainable national development; Continuing to innovate the organization and improve the quality of activities of the National Assembly.

Continue to well implement the institution of the President according to the Constitution; Continue to innovate the organization and operation of the Government and local authorities; build a state administration that serves the people, is professional, rule of law, modern, effective and efficient; Build a judiciary that is professional, modern, fair, strict, honest, serving the Fatherland and the people; Perfect the mechanism to control State power; Strengthen the prevention and fight against corruption and negativity.

Strengthen and proactively integrate into the international community to meet the requirements of building and perfecting the Vietnamese socialist rule-of-law state, building and defending the Fatherland in the new situation; Strengthen the leadership of the Party, promote the role of the Vietnam Fatherland Front and the people in building and perfecting the Vietnamese socialist rule-of-law state.

Regarding implementation, the Politburo issued a Plan to implement the Resolution; led and directed its synchronous, timely and effective implementation, creating strong changes in the awareness and actions of the entire political system and society in building and perfecting the socialist rule-of-law State of Vietnam.

Provincial and municipal Party Committees, Party committees, Party executive committees, Party delegations, and Party committees directly under the Central Committee shall organize research, study, dissemination, development of programs and plans, and organization of implementation of the Resolution.

The National Assembly Party Delegation, the Government Party Committee, the Supreme People's Court Party Committee, and the Supreme People's Procuracy Party Committee direct the review, amendment, and supplementation of relevant legal documents to ensure consistency and unity, creating a legal basis for the task of building a socialist rule-of-law state in Vietnam and supervising the implementation of the Resolution.

The Vietnam Fatherland Front and socio-political organizations shall strengthen supervision and social criticism, promote mobilization of all classes of people to actively participate in building the socialist rule-of-law state of Vietnam and supervise the implementation of the Resolution.

The Central Propaganda Department presides over and coordinates with the Central Internal Affairs Department to assist the Politburo and the Secretariat in guiding, organizing research, study, dissemination, propaganda, and popularization of the Resolution; and directs press agencies to strengthen propaganda about the Socialist Republic of Vietnam's rule-of-law State and the implementation process of the Resolution.

The Central Committee for Internal Affairs shall preside over and coordinate with relevant agencies to regularly urge, guide, inspect and supervise the implementation of the Resolution; periodically summarize and report to the Politburo and the Secretariat.
