Conference of specialized National Assembly deputies: Contributing quality opinions to draft laws

The result of careful, early preparation and coordination

Speaking at the opening of the Conference, National Assembly Chairman Vuong Dinh Hue said that thoroughly grasping the Resolution of the 13th National Party Congress and the direction of General Secretary Nguyen Phu Trong on strongly promoting the role and position of the National Assembly in creating a legal framework for the country's activities, serving socio-economic development, ensuring national defense, security and foreign affairs, since the beginning of the term, the 15th National Assembly has successfully held 4 sessions, promulgated 8 laws, commented on 6 other draft laws, and issued 62 resolutions with high unity and consensus.

"This is the result of a careful and early coordination process of the National Assembly Standing Committee (NASC), the Government, NA agencies and relevant agencies, combined with promoting democracy, making the most of the wisdom and contributions of voters and people, the domestic and foreign business community, revolutionary veterans, experts, scientists, etc.; including the important, active, responsible, dedicated and effective contributions of NA deputies in general and full-time NA deputies in particular," said NA Chairman Vuong Dinh Hue.

According to National Assembly Chairman Vuong Dinh Hue, the upcoming 4th session of the National Assembly has many important legislative tasks. The projects and drafts expected to be submitted to the National Assembly for approval have been directed by the National Assembly Standing Committee and the Government to be discussed and consulted through many rounds, at many conferences and consultation workshops.

The Standing Committee of the National Assembly also gave detailed opinions on major issues that still had different opinions at the first specialized law-making session of the Standing Committee of the National Assembly (from August 15-18, 2022)..

In order to have more diverse and multi-dimensional opinions, helping relevant agencies identify new issues, grasp comprehensively, explain more thoroughly, and ensure the highest quality of projects and drafts submitted to the National Assembly, the Standing Committee of the National Assembly decided to organize a conference of full-time National Assembly deputies so that full-time National Assembly deputies could give their opinions on each project. Thereby, contributing to the consideration and approval of the National Assembly with a high approval rate, at the same time, shortening the session time.

Focus on discussing 6 draft laws and 1 draft resolution

With that spirit, the 2nd Conference of full-time National Assembly deputies of the 15th tenure will focus on discussing 6 draft laws and 1 draft resolution to be submitted to the National Assembly for approval.

Accordingly,First, on the draft laws that were commented on at the 3rd session., submitted to the National Assembly for consideration and approval at the 4th session: The majority of National Assembly deputies expressed high approval of the necessity of promulgation and agreed with many main contents of the draft laws.

Up to now, the contents have been basically agreed upon, only a few issues still have different opinions.

Specifically, aboutDraft Law on Implementing Democracy at Grassroots Level.Up to now, there are still some issues that National Assembly deputies should continue to pay attention to and clearly express their opinions and viewpoints on: Adjusting the implementation of democracy in enterprises and other organizations that hire and use labor under labor contracts; concretizing the motto "people know, people discuss, people do, people inspect, people supervise, people benefit";...

On the Draft Law amending and supplementing a number of articles of the Law on Radio Frequencies,National Assembly Chairman Vuong Dinh Hue asked National Assembly deputies to continue discussing and clearly express their views on the following issues.

One is to regulate the total bandwidth of mobile information that a business is licensed to use.

Second, licensing method; re-issuing frequency band licenses, clarifying why, nearly 12 years after the Law took effect, the auction and selection process for licensing has not been carried out.

Third, the regulation on the use of radio frequencies allocated exclusively for national defense and security to combine with economic development - this content is still having different views, it is necessary to clarify the content of this policy and assess the impact related to planning and frequency band usage plans, including technical and technological aspects to ensure feasibility...

Regarding the Draft Law on Medical Examination and Treatment (amended),National Assembly Chairman Vuong Dinh Hue asked the National Assembly deputies to focus on discussing groups of issues: First,,on the scope of regulation. Second, on the structure of the draft Law. Third,,on the authority and conditions for granting a license to practice medical examination and treatment. Fourthly, the system of medical examination and treatment facilities; methods of referral and connection of medical examination and treatment facilities; decentralization of private medical facilities;...

On the draft Law on Prevention and Control of Domestic Violence (amended),Suggesting that the National Assembly deputies focus on discussing and clarifying: First, identifying acts of domestic violence; expanding to a number of groups of subjects who are no longer in marital or family relationships. Second, on counseling, mediation and handling of reports and denunciations of cases; protecting and supporting those who report domestic violence and those who participate in preventing and combating domestic violence. Third, facilities to support the prevention and combat of domestic violence and the socialization of the work of preventing and combating domestic violence. Fourth, measures to prohibit contact according to the decision of the Chairman of the People's Committee at the commune level and the court;...

Regarding the draft Law on Inspection (amended),Requesting the National Assembly deputies to give their opinions on the following contents: One is,The system of organizing inspection agencies according to administrative levels; solutions to ensure professional and technical independence in inspection activities. Second,,The establishment of specialized inspection agencies at General Departments, Departments under Ministries and at Government agencies, other State agencies assigned to perform certain State management tasks. Third, the criteria for establishing inspection agencies at some departments and the authority to establish Department Inspectorates of the Provincial People's Committee. Fourth, the inspection process, coordination and handling mechanisms to avoid overlap and duplication in inspection activities with inspection and auditing activities...

Second, about 1 draft law, 1 draft resolution submitted to the National Assembly for approval at the 4th sessionaccording to the procedure of a session.

Specifically, vRegarding the draft Law on Anti-Money Laundering (amended),National Assembly Chairman Vuong Dinh Hue asked the National Assembly deputies to focus on discussing the necessary and sufficient conditions for submitting the draft Law to the National Assembly for consideration and approval according to the one-session process. Second, the constitutionality, legality, consistency of the draft Law with the legal system and compatibility with international commitments and treaties; feasibility in implementation. Third, regulations on reporting subjects; internal regulations on anti-money laundering; reporting of suspicious transactions, responsibilities of state agencies in anti-money laundering, etc.

Regarding the draft Resolution promulgating the Rules of the National Assembly session (amended),It is recommended that National Assembly deputies, especially those with many years of experience in the National Assembly, focus on giving opinions on the right to debate of National Assembly deputies; principles and criteria for debate in questioning activities. Second, the criteria and conditions for the National Assembly Chairman and Vice Chairman to chair the session should be flexibly adjusted, shortening the speaking time of National Assembly deputies, inviting National Assembly deputies to speak, question, and debate outside the registered order. Third, the authority to receive and revise draft resolutions on important socio-economic issues during the period between two National Assembly sessions; the content, process, and procedures for drafting resolutions of National Assembly sessions...

Emphasizing that the Conference only has 2 days to give opinions on 6 draft laws and 1 draft resolution, the National Assembly Chairman requested that full-time National Assembly deputies, with a high sense of responsibility to voters and the country, fully participate in all meetings, clearly demonstrate their role as a bridge between practice and theory, between the thoughts and aspirations of voters and people and the decisions submitted to the National Assembly for consideration and approval; make the most of the time and opportunity to study, exchange, debate, and criticize with the drafting agency and the reviewing agency in order to contribute many quality and profound opinions on the drafts.

"The opinions of full-time National Assembly deputies will be an important basis for relevant agencies to continue perfecting the draft Law with the goal of ensuring the highest quality for submission to the National Assembly for consideration and decision at the 4th session," said National Assembly Chairman Vuong Dinh Hue.

After the opening speech of the Conference by National Assembly Chairman Vuong Dinh Hue, under the direction of National Assembly Vice Chairman Nguyen Khac Dinh, the Conference listened to reports and discussed the draft Law on Inspection (amended) and the draft Law on Implementing Democracy at Grassroots Level.
