More than 10,000 hectares of forestry land in Nghe An were illegally transferred and used for the wrong purpose.

According to the report of the Department of Agriculture and Rural Development, up to now, the People's Committees at all levels have allocated 139,579.57 hectares of land to households, individuals and communities for forestry purposes. Of which, 122,894.88 hectares have been granted land use right certificates.
Currently, the province still has 203,521.24 hectares of unallocated forest and forestry land. Of which, natural forest is 194,583.08 hectares and planted forest is 8,938.16 hectares.
In Nghe An province, there are currently 12 agricultural and forestry single-member limited liability companies (LLCs), including 05 forestry companies and 07 agricultural companies, with a total forestry land assigned for management and use of 59,385.4 hectares; accounting for 4.80% of the total forestry land area in the whole province.

Currently, in Nghe An, the Provincial People's Committee has leased forestry land to 6 enterprises to implement the project with a total area of 6,144.9 hectares; accounting for 0.5% of the total forest and forestry land area in the whole province. Up to now, the companies are basically implementing forest planting and other project items on the leased area. In particular, InnovGreen Nghe An Joint Stock Company has not implemented it since 2011 and 2 companies Nam My and Kieu Phuong have had a part of their land encroached by people for forest planting.
The illegal buying, selling, transferring and misuse of forestry land occurs in most localities in the province, in many different forms such as (borrowing, pledging, mortgaging, hand-to-hand selling, loss, etc.). According to the statistics, the total area of illegally bought, sold and transferred forestry land is about 10,038 hectares. Concentrated in the districts of Quy Hop, Que Phong, Quy Chau, Con Cuong and Anh Son.
In addition, the Management Boards of Special-Use Forests and Protective Forests are public service units assigned by the State to manage special-use forests, protective forests and some areas of production forest land interspersed within the forests. These areas of production forests have not yet been allocated or leased.
Currently, the land allocation and land lease have been carried out to issue forest land use right certificates to households and individuals in the province, but the forest allocation and lease have not been carried out. The whole province has only allocated 2,060 hectares of forest to Viet Real Estate Financial Investment Company, TH Pharmaceutical Joint Stock Company; Prison Police No. 6 and assigned to the village community, Hanh Dich commune, Que Phong district for management and use.
Some areas have been allocated land and granted land use right certificates, but the people who were allocated land could not determine the boundaries in the field, leading to disputes and not meeting the conditions for granting land use right certificates to the people, such as Ky Son district.

Land allocation, land lease, and issuance of land use right certificates, but not yet linked to forest allocation and lease, so the forest still has no owner, leading to deforestation, exploitation, and conversion, causing forest degradation in some localities.
According to Director of the Department of Agriculture and Rural Development Hoang Nghia Hieu, the current difficulty is that the budget for forest allocation and leasing has not been allocated from the budget for localities to proactively implement. The planning of 3 types of forests in the province still has many shortcomings, lack of synchronization, unclear cadastral boundaries, forest land disputes, and many overlapping plans that are difficult to resolve. People are allocated land and granted forest land use right certificates, where there are forests, they themselves realize that they have full rights to use the land and use the forest, so it is not necessary to complete the forest allocation dossier...
Based on practical requirements, it is necessary to develop a project on forest allocation and forest lease associated with land allocation and issuance of forestry land use right certificates toapplied to the entire area of forestry land under the planning of production forests, including land with natural forests and land with forests planted with State investment capital in the whole Nghe An province.
According to calculations, the funding source for implementing the Project is more than 292 billion VND, striving to complete forest allocation and lease of 101,678/343,100 hectares by 2021.

Group discussion 6: Hot issue of allocating forest land to people for production
(Baonghean.vn) - At the discussion session of group 6 in the 6th session of the 17th People's Council on the afternoon of July 18, many People's Council delegates of Que Phong, Quy Chau, and Quy Hop districts mentioned the shortcomings in the policy of allocating forest land to people for production.

(Baonghean.vn) - Voters in Quy Chau district requested to be allocated land and issued certificates as soon as possible according to regulations. Along with that, people need to be guided and trained to know how to effectively and legally exploit the allocated land.
Concluding this content, Chairman of the Provincial People's Committee Nguyen Xuan Duong emphasized that Nghe An has not yet issued a project, which is slow. To ensure that the forest has an owner, the issuance of the project is very necessary and needs to be approved soon. However, the handover of forests still has many issues: unit price, area, funding source... which need to be done accurately, ensuring feasibility. It is necessary to properly implement the principles and procedures prescribed by law on forest allocation and leasing and must have the participation of the people; harmoniously resolve social relations, ensure fairness, transparency and public democracy.
Propose that the Department of Agriculture and Rural Development absorb the opinions; consult with the Ministry of Agriculture and Rural Development, and experience from the provinces to determine the appropriate assignment method to develop and complete the project, and resubmit it in the next meeting.
