More than 4,000 administrative penalty decisions have not been enforced.

(Baonghean.vn) - This is one of the difficulties and limitations mentioned at the conference summarizing 5 years of implementing the Law on handling administrative violations in Nghe An province on the afternoon of July 21.

After the Law on Handling of Administrative Violations 2012 was promulgated, the People's Committee of Nghe An province promptly and proactively issued many documents to effectively implement the Law on Handling of Administrative Violations in the province. Information agencies in the province such as Nghe An Newspaper and Nghe An Radio and Television Station are agencies that hold important positions in the work of propagating and disseminating the law on handling of administrative violations to the people.

Awareness of organizations, individuals and people in law enforcement has changed a lot, ensuring order and discipline in social management, protecting the interests of the State, and improving the effectiveness of state management by law.

From 2013 to present, competent organizations and individuals in Nghe An province have issued 1,005,707 decisions on administrative sanctions, collecting 745,948,178,756 VND in fines and 68,698,213,640 VND from the sale and liquidation of confiscated exhibits and means of administrative violations.

However, there are still many problems related to the implementation of the Law on Handling of Administrative Violations. Up to now, 1,001,645 decisions on handling administrative violations have been implemented, while 4,062 decisions have not been implemented.

This reality is due to a number of reasons such as some organizations and individuals who violate the law have difficult economic conditions and are unable to execute the decision; some subjects deliberately do not comply with the penalty decision, the organization of enforcement is difficult, the cost of organizing enforcement of the penalty decision is many times greater than the amount of the fine; the execution of the administrative penalty decision in the case of subjects who are freelance workers, living in remote areas, areas with complex terrain is difficult.

At the conference, the delegates also pointed out some difficulties, obstacles, limitations and shortcomings in the implementation of the Law on Handling of Administrative Violations, such as in some ethnic minority areas, the specialized and core forces are still thin, there is a language barrier, hindering the dissemination of the law. The coordination between some sectors and functional agencies in handling administrative violations is not really tight and regular, sometimes lacking in unity and synchronization.

In addition, some provisions of the Law are not specific enough, causing difficulties in implementation. On that basis, delegates proposed a number of recommendations and solutions to improve the effectiveness of the Law.

Concluding the conference, comrade Le Xuan Dai - Member of the Provincial Party Committee, Permanent Vice Chairman of the Provincial People's Committee highly appreciated the efforts and results achieved in the implementation of the Law on handling administrative violations of all levels and sectors in the past time.

At the same time, all levels and sectors are required to learn from practical experience, overcome difficulties, and effectively implement the provisions of the Law, in order to raise people's awareness of law compliance.

On this occasion, the Provincial People's Committee awarded certificates of merit to 8 collectives and 7 individuals with outstanding achievements in 5 years of implementing the Law on handling administrative violations.
