Reply:Disciplinary action against cadres, civil servants and public employees in the enforcement of the law on handling administrative violations is stipulated in Article 23, Decree 19/2020/ND-CP, amended by Clause 13, Article 1, Decree 93/2025/ND-CP, specifically as follows:
- Principles, authority, order, procedures, level of violation and other contents related to disciplinary action against cadres, civil servants and public employees who commit violations in the enforcement of laws on handling administrative violations shall be implemented according to the provisions of law on disciplinary action against cadres, civil servants and public employees.
- Officials, civil servants and public employees who commit violations and have an attitude of acceptance, correction and proactively overcoming the consequences will be considered for a reduction in disciplinary action.
- Cases considered for exemption from disciplinary responsibility include:
+ Cases specified in the Government's Decree on disciplinary action against cadres, civil servants and public employees;
+ Violations by officials, civil servants and public employees stemming from the fault of the administrative violator;
+ The person issuing the decision in handling administrative violations self-checks, discovers errors and has corrected the errors according to regulations without causing any consequences.
