Government Inspector General Le Minh Khai said that the work of preventing and combating corruption in 2018 has made great strides, achieved many clear results, created positive effects, and spread strongly throughout society.

Continuing the 27th Session, the National Assembly Standing Committee spent the whole day of September 14 giving opinions on the work reports of the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy; the Government's reports on crime prevention and control, law enforcement, and corruption prevention and control in 2018.

Handling many high-ranking officials who committed crimes

Examining the Government's report on crime prevention and law violations, Chairwoman of the National Assembly's Judiciary Committee Le Thi Nga said that the Committee basically agreed with the Government's assessment.

The Judiciary Committee noted that in 2018, the Government directed ministries and branches, with the Public Security force as the core, to deploy many plans and schemes to prevent crimes and violations of the law, and to resolve security and order hotspots incited by reactionary elements who distorted the Party and State's policies and guidelines; and to strictly handle many officials, including high-ranking officials, who committed crimes, assisted and covered up criminals...

However, the audit report clearly stated: The number of deaths due to consequences of law violations and crimes in the field of social order infringement increased (1,187 deaths, up 1.63%; rape crimes increased 7.11%, murder crimes due to social causes increased 2.18%, including a number of cases of multiple murders with savage, brutal methods causing outrage and anxiety in society).

Notably, there have been a number of cases involving the complicity and participation of a number of high-ranking officers in the police force.

A typical case is the CNC Company organizing online gambling on the Internet in the form of card games with nearly 43 million participating accounts, the total illegal profit is over 9,853 billion VND, confiscated over 1,760 billion VND; initiating investigation, clarifying 105 defendants for related crimes, including the participation and assistance of a number of high-ranking officers of the General Department of Police, Ministry of Public Security.

In addition, some individuals and businesses have colluded with officials in positions of authority in some localities to create "interest groups" or take advantage of their professional work to create "front organizations" to use their influence to buy, sell, and transfer public assets at low prices without auction, without proper authority in some localities, showing signs of violating the law, causing great losses to state assets and land.

Some violations of state management of land have lasted for many years and have only recently been discovered and handled.

In addition, the security and order situation in some provinces and large cities continues to be complicated. Some types of crimes such as theft and robbery are common and public; suspects are ready to fight back fiercely, causing insecurity among the people.

Specifically, the case of 5 "knights" being stabbed to death and injured by a group of thieves on May 13 in Ho Chi Minh City or the case of Tran Ngoc Danh and Le Minh Huu Nghia robbing and seriously injuring 2 people chasing them on May 29 in Tan Phu district (Ho Chi Minh City)...

According to Chairwoman of the Judiciary Committee Le Thi Nga, crimes and law violations related to "black credit" activities with very high interest rates, leading to debt collection, property extortion, illegal detention... are very complicated in many localities, but the fight and prevention are still not effective.

In addition, the falsification of psychiatric records to help some subjects evade criminal responsibility after committing crimes has occurred for many years, and was recommended by the Judicial Committee since 2013, but to date there has been no radical solution and is showing signs of becoming more serious.

Resolutely eliminate corrupt and corrupt officials

Presenting the Government's Report on anti-corruption work in 2018, Government Inspector General Le Minh Khai said that anti-corruption work in 2018 has made great progress, achieved many clear results, created positive effects, spread strongly throughout society, received the consensus and high appreciation of the people, and was recognized by international organizations.

Corruption prevention and control has been linked to personnel work, strictly handling violations according to Party and State disciplinary regulations and criminal proceedings. Many particularly serious and complicated corruption and economic cases that have attracted public attention have been discovered, investigated, prosecuted, and tried strictly and lawfully, without any forbidden areas.

However, the Government also frankly pointed out the limitations in this work. Accordingly, there are still some ministries, branches and localities that appoint leaders and managers who lack conditions, standards, qualities and capacity; assign relatives to job positions or allow relatives to do business within the scope of management, violating the law on anti-corruption.

Notably, the situation of “petty corruption” has not been effectively prevented. The number of cases and cases discovered and handled does not accurately reflect the reality of corruption, especially the detection and handling work at the local level…

To make corruption prevention and control more effective, in 2019, the Government proposed a series of specific solutions and tasks.

Accordingly, we will continue to develop and perfect draft laws to prevent corruption; promote administrative reform; focus on effectively handling and preventing harassment and inconvenience to people and businesses in handling work.

“Resolutely eliminate corrupt and corrupt officials from the Party and State apparatus, first of all in anti-corruption agencies,” the Inspector General emphasized, adding that the Government will inspect the planning, rotation, promotion, and appointment of officials nationwide; resolutely cancel and revoke incorrect decisions on personnel work, and strictly handle organizations and individuals who violate the law.

Chairwoman of the Judiciary Committee Le Thi Nga said that the Government's report only mentioned a number of agencies, units, and localities that did well, but did not point out which agencies, units, and localities did not do a good job in preventing and combating corruption.

Besides, there is no solution to completely resolve and rectify the situation of excess deputy positions, the situation of appointing many officials before retirement, and appointing officials who do not meet the prescribed standards, causing skepticism in public opinion.

The implementation and verification of asset and income declarations are still formal; the handling of responsibilities of leaders for corruption still has some limitations, not commensurate with the corruption cases discovered and handled...

Step up detection of "petty corruption"

Speaking at the meeting, Head of the People's Petition Committee of the National Assembly Standing Committee Nguyen Thanh Hai highly appreciated the reports, especially the report of the Public Security sector.

Ms. Nguyen Thanh Hai said that voters and people highly appreciate the professionalism of the police force, which has recently solved major drug cases and serious murder cases...

In addition, the work of restructuring the structure, organization and apparatus of the industry has also received attention and welcome from voters nationwide; thereby showing the determination and efforts of the entire industry to reform, improve operational efficiency and serve the people.

According to Head of the People's Petition Committee Nguyen Thanh Hai, people are also interested in publicizing the results of corruption cases and cases that have been pending for many years but have recently been resolved.

The number of inspection conclusions and the implementation of inspection conclusions have been of interest and reviewed by the Government Inspectorate.

Regarding “petty corruption”, reports clearly state: “The situation of harassment and inconvenience to people and businesses has not been effectively prevented…”.

Agreeing with this opinion, Head of the People's Petition Committee Nguyen Thanh Hai emphasized that people are often harassed and inconvenienced when dealing with officials and civil servants every day.

“Why is it that outsiders know about petty corruption but not insiders? The phenomenon of corruption is sophisticated and varied, but why do people still know about it?” - Ms. Hai said and suggested stepping up the work of detecting corruption within agencies and taking drastic measures to deal with it; otherwise, the situation of “petty corruption” will erode like “termite nests in great projects”.

Deputy Head of the Central Internal Affairs Commission Nguyen Thai Hoc highly appreciated the reports of the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy; the Government's report on crime prevention and control, law enforcement, and corruption prevention and control in 2018 and said that the reports were carefully prepared, assessing both advantages and disadvantages.

The highlight is that crime in 2018 was controlled and reduced, especially corruption crimes. In addition, the investigation, prosecution and trial work had many positive changes...

However, delegate Nguyen Thai Hoc also pointed out some shortcomings and limitations. That is the dangerous crime situation with a particularly serious nature and level occurring in many localities, making voters very worried.

Meanwhile, localities are still confused, passive, and indecisive. These cases also raise issues of family relationships, social ethics, and effective prevention and control solutions.

Regarding the fight against corruption, Deputy Head of the Central Internal Affairs Commission Nguyen Thai Hoc commented that this work has had positive changes, but the synchronization and spirit of fighting against corruption of ministries, branches, provinces and cities need more attention.

The Central Steering Committee on Anti-Corruption has assessed that there have been positive and strong changes at the central level, but at the local level there has not been any real change, and the situation is still "hot above, cold below".

Delegate Nguyen Thai Hoc pointed out that in reality, some Party committees and authorities lack attention and direction, and there is a situation of deference and avoidance. Effective solutions are needed to rectify this situation.

Many delegates suggested that the National Assembly and the Government need to develop and perfect a mechanism to monitor and control the exercise of power to prevent and combat corruption. The Central Steering Committee on Anti-Corruption, the Government, and the State Audit directed to focus on comprehensively inspecting, examining, and auditing the purchase, sale, and transfer of public assets such as land and houses in provinces and cities nationwide; inspecting, examining, and auditing the equitization of state-owned enterprises.
