Sentenced for cutting samu wood to build a house

On the morning of April 27, the People's Court of Ky Son district opened the first-instance trial of the case "Violating regulations on forest exploitation and protection and forest products" against defendant Lau Ba Co (born in 1987), residing in Tong Khu village, Na Ngoi commune (Ky Son).

According to the indictment, around July 2020, Lau Ba Co entered the forest in Lot 4, Compartment 9, Sub-area 493, forest area managed by the Ky Son District Forest Protection Management Board to pick medicinal leaves. Here, Co discovered a tree.samu woodThe tree had been cut down a long time ago, so he decided to saw it down and bring it home to build a house. About a week later, Co borrowed a chainsaw and went into the forest to cut the tree into 4 equal parts. Then, Co returned home and hired Luong Van Tha (born in 1989), residing in Tang Phan village, Na Ngoi commune, to cut the wood into panels. Within 3 days, Co and Tha hadlike to cut woodinto 176 planks of the same size (250cm x 40cm x 2cm) and 3 square columns of the same size (260cm x 19cm x 14cm). The amount of wood that Lau Ba Co sawed was determined to be 3.527 m3.
Conclusion of appraisal No. 607/CNR-VP dated December 11, 2020 of the Forest Industry Research Institute of Vietnam Forestry Science Institute concluded that "Wood speciessandalwood oil(Cunninghamia konishii) belongs to group IA in the "List of endangered and rare forest plants and animals" issued with Decree No. 06/2019/ND-CP dated January 22, 2019 of the Government onForest vegetation management, endangered, precious and rare wild animals and implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora".
At the trial, defendant Lau Ba Co confessed and admitted all his crimes, the purpose of exploiting the above wood was to build a house.
Considering the nature and level of the defendant's behavior as well as his awareness of the law, the panel sentenced the defendant to 2 years in prison but suspended the sentence, with a probation period of 4 years.
