Tired of "living temporarily"

In village 5, Long Son commune, there are currently 20 households, who are workers of Anh Son Livestock Breeding Station, whose houses have been sold at a fixed price by the unit and have been living and building stable houses for decades, however, up to now, they have not been granted land use rights.Land use right certificateAlthough people have petitioned many times, the solution is still at a standstill.

From QL7A, turn about 2 km to the rice fields and farms, ponds, and livestock lakes of Anh Son Livestock Breeding Station, now Tay Nghe An Livestock Breeding Station. Different from the image of the Livestock Breeding Station area with only farms and shabby collective houses, instead there are spacious houses, surrounded by fish ponds and rice fields.

Ms. Hoang Thi Lien, a worker at the seed station since 1973, said: In 1972, this seed station was established and one year later she was hired to work. At first, this area was very wild, dozens of workers from the lowlands came here to work and were assigned to live in collective houses. The task of the seed station at that time was to research, crossbreed and breed livestock, poultry, fish and rice varieties to supply to the districts in the southwest of Nghe An.

After a period of working, to ensure stable housing for workers when they got married, in the late 1980s and early 1990s, the unit created conditions for selling at a discount and providing each household with a small piece of land in barren areas that were no longer productive to build houses.

“After a period of building houses, administratively, 20 households are under the management of Long Son commune, but the land belongs to the seed station, so, to ensure the education of our children and to stabilize our lives in the long term, we have also requested to transfer the area where the households are living to the local authorities for management and issuance of land use right certificates. In 2014, the Provincial People's Committee decided to reclaim the land area that the households are living in and hand it over toAnh Son district, however, I don't understand why until now we still haven't been able to complete the procedures to be granted a Land Use Rights Certificate" - Ms. Lien wondered.

The land plot where Ms. Lien's family is currently living has an area of ​​1,081.7 m2.2Because she did not have a land use right certificate, many times her family wanted to borrow money from the bank to do business and invest in their children's education, but could not, so they had to borrow from other places with higher interest rates.

Similarly, Mr. Tran Van Ha, a soldier who transferred to work as a worker at Anh Son Livestock Breeding Station since 1984, was sold by the unit at a discounted price for his current plot of land to live on in 1987. Currently, Mr. Ha's family's plot of land has an area of ​​1,113.7 m2, but because he has not been granted a land use right certificate, he is almost in a "temporary" situation, even though his family and other workers' households have lived stably here for decades.

According to our research, on October 29, 2014, the Provincial People's Committee issued Decision No. 520/QD-UBND.DC to reclaim 32,512.1 m2Agricultural land in Long Son commune is managed by Anh Son Livestock Breeding Station, under Nghe An Livestock Breeding Center.

This area is mainly land for perennial crops and land for annual crops, including land plot No. 774, map sheet No. 9; land plot No. 495, map sheet No. 13; land plot No. 496, map sheet No. 13 and land plot No. 497, map sheet No. 13. The reason for the revocation is that Anh Son Livestock Breeding Station no longer has a need to use it. After the revocation, the Provincial People's Committee also assigned the Anh Son District People's Committee to manage the entire above-mentioned land for use according to legal planning.

Waiting for plan

Although the land recovery area of ​​the livestock breeding station according to Decision 520 of the Provincial People's Committee is 32,512.1 m2, but in fact, according to the latest measurements ofLong Son Commune People's CommitteeThe area that 20 households are using is 40,205.1 m2.

Mr. Nguyen Huu Lan - a land official of Long Son commune said: The area of ​​land for livestock breeding stations where people have lived for a long time has been subject to a land recovery decision by the province, however, when making a land use plan to allocate land and issue land use right certificates to households, there were difficulties because this area was not subject to land recovery from agricultural and forestry farms, so it could not be implemented according to the general direction of the province.

On September 13, 2021, the People's Committee of Long Son commune also sent a report to the People's Committee of Anh Son district, in which the local government proposed 2 options to resolve this issue. Option 1 is to allow the People's Committee of the commune to guide people to prepare documents for granting Land Use Right Certificates without going through the land use plan, because it is not in the agricultural and forestry land fund. Option 2 is to prepare a land use plan to allocate land and grant Land Use Right Certificates. However, up to now, there has been no specific response from Anh Son district, so the above proposed options have not been implemented.

Working with us, Mr. Bui Cong Duyet - Head of Tay Nghe An Livestock Breeding Station (formerly Anh Son Livestock Breeding Station) said: It is said that Anh Son Livestock Breeding Station no longer has a need to use it, but in reality, in the late 80s and early 90s of the last century, because many workers of the breeding station did not have a house, the unit sold the collective house at a discount so that they could build houses.

Later, the local government requested the unit to return the land, so it returned it. After returning the land, the unit no longer had any responsibilities or obligations. Currently, according to Mr. Duyet, after returning the land to the locality, the unit still has about 10 hectares to manage and use, mainly for pig breeding farms, fish ponds and rice fields.

Mr. Bui Cong An - Head of the Department of Natural Resources and Environment of Anh Son district said: The land area where 20 households are living was previously granted by Anh Son Livestock Breeding Station without authority. Currently, the district is reviewing cases of granting without authority but in accordance with the planning to issue the first Land Use Right Certificate.

After the commune has submitted a plan and based on the current situation and people's needs, it will be assessed and considered for handling. "This year, the district is focusing on handling cases of unauthorized issuance and self-conversion of land use purposes. For cases that meet the conditions, we will consider issuing certificates to people, and if there are any problems, we will compile them to ask for guidance from the province" - Mr. An emphasized./.
