Some new points of the Law on Election of National Assembly Deputies and People's Council Deputies 2015

(Baonghean)- Inheriting the provisions of the 2010 Law on Election of National Assembly Deputies and the 2003 Law on Election of People's Council Deputies (hereinafter referred to as the Old Law); on the other hand, to comply with the 2013 Constitution; on June 25, 2015, at the 9th session, the 13th National Assembly passed the 2015 Law on Election of National Assembly Deputies and People's Council Deputies.

The Law consists of 10 chapters and 98 articles, effective from September 1, 2015. Below, we would like to introduce some new points of the Law.

FirstThe Law on Election of Deputies to the National Assembly and People's Councils 2015 stipulates that the right to decide on the national election date for the election of deputies to the National Assembly and People's Councils at all levels; to decide on the election of additional deputies to the National Assembly during the mid-term; to decide on and establish the National Election Council is the authority of the National Assembly instead of the Standing Committee of the National Assembly as before (Clause 1, Article 4). The election date must be a Sunday and be announced at least 115 days before the election date (the old law was 105 days).

Monday,The 2015 Law on Election of Deputies to the National Assembly and People's Councils stipulates that the number of ethnic minorities nominated as candidates for the National Assembly is proposed by the Standing Committee of the National Assembly based on the proposal of the National Assembly's Ethnic Council, ensuring that at least 18% of the total number of people on the official list of candidates for the National Assembly are ethnic minorities. The number of women nominated as candidates for the National Assembly is proposed by the Standing Committee of the National Assembly based on the proposal of the Presidium of the Central Executive Committee of the Vietnam Women's Union, ensuring that at least 35% of the total number of people on the official list of candidates for the National Assembly are women (Clause 2 and 3, Article 8).

Tuesday,The 2015 Law on Election of Deputies to the National Assembly and People's Councils stipulates that the National Election Council established by the National Assembly (the old Law called it the Central Election Council established by the National Assembly Standing Committee) has the task of organizing the election of National Assembly deputies; directing and guiding the election of People's Council deputies at all levels.

Wednesday,The 2015 Law on Election of Deputies to the National Assembly and People's Councils stipulates that people who are being detained, people who are serving compulsory education or compulsory drug rehabilitation measures will also be included in the voter list to elect National Assembly deputies and People's Council deputies of the province where they are being detained, educated or are being compulsory drug rehabilitation (Clause 5, Article 29).

Thursday,The standards for candidates for the National Assembly are stipulated in the Law on Organization of the National Assembly, and the standards for People's Council delegates are stipulated in the Law on Organization of Local Government. Based on the provisions of the Law on Organization of the National Assembly and the Law on Organization of Local Government, agencies, organizations and units that are entitled to introduce candidates need to promote their responsibilities, introduce typical candidates, of appropriate age, with sufficient talent and virtue so that voters have the conditions to choose people who are truly worthy to be their representatives to ensure quality and gradually improve the capacity and qualifications of the representatives.
