Nghe An: Regulations on management of operations of rudimentary vehicles, four-wheeled motor vehicles, motorbikes, and mopeds

The Provincial People's Committee has just issued Decision No. 36/2025/QD-UBND regulating the management of the operation of rudimentary vehicles, four-wheeled motor vehicles, motorbikes, and mopeds in the province.

Decision No. 36 detailing a number of articles ofLaw on Road Traffic Order and SafetyNo. 36/2024/QH15 dated June 27, 2024 applies in the province. Contents not specified in this Decision shall be implemented in accordance with current legal regulations.

Regarding scope of operation: Primitive vehicles are allowed to operate on roads within the province, except for highways and areas and routes where operations are prohibited or restricted according to regulations.

Four-wheeled motorized cargo vehicles and four-wheeled motorized passenger vehicles shall comply with the provisions of Clause 2, Article 24 of Decree No. 165/2024/ND-CP dated December 26, 2024 of the Government detailing and guiding the implementation of a number of articles of the 2024 Road Law and Article 77 of the Law on Road Traffic Order and Safety.

Goods loaded on rudimentary vehicles must be safe, not obstruct traffic or obscure the driver's vision.

In this Decision, the Provincial People's Committee has specified the drivers and users of vehicles, regulations on loading and unloading goods, regulations on stopping and parking locations for picking up and dropping off passengers for the operation of motorbikes, mopeds, and rudimentary vehicles for passenger and cargo transportation business. At the same time, regulations on vehicles and drivers for the operation of four-wheeled motor vehicles.

Specifically, the loading and unloading of goods is regulated as follows: Motorcycles and motorbikes are not allowed to load goods exceeding the width of the rack on each side by 0.3m, exceeding the rear of the rack by 0.5m according to the manufacturer's design, the height of the goods loaded from the road surface must not exceed 2.0m; Goods loaded on rudimentary vehicles must ensure safety, not obstruct traffic and obscure the driver's vision. Goods loaded on the vehicle must not exceed 1/3 of the vehicle body length and not exceed 1.0m in front and behind the vehicle; not exceed 0.4m on each side of the wheel.

The following regulations apply to the locations for stopping and parking passengers to pick up and drop off passengers: The locations for stopping and parking passengers to pick up and drop off passengers must be in the correct locations, not obstructing traffic, and ensuring environmental hygiene, order, and road traffic safety. On the road, vehicles may only be stopped and parked in places with wide sidewalks or on land outside the roadway; in cases where the sidewalks are narrow or there is no sidewalk, vehicles may only be stopped and parked close to the right edge of the road in the direction of travel; without obstructing or endangering people and vehicles participating in road traffic. On the street, vehicles may only be stopped and parked close to the right edge of the road or sidewalk in the direction of travel; without obstructing or endangering people and vehicles participating in road traffic. Encourage the application of information technology in passenger and cargo transportation by motorbike, scooter, and rudimentary vehicles in the province.

Regarding operating hours: Four-wheeled motor vehicles operating in the transport business are allowed to transport passengers from 5:00 a.m. to 12:00 p.m. daily.

Four-wheeled motor vehicles not used for commercial transport may operate 24 hours a day. Four-wheeled motor vehicles may operate for transporting goods 24 hours a day.

Decision 36/2025/QD-UBND takes effect from June 10, 2025.

The Provincial People's Committee assigns the Department of Construction to preside over and coordinate with relevant departments, branches, agencies and the People's Committees of districts, towns and cities to propagate, guide, inspect and urge the implementation of this Decision. Coordinate with relevant agencies to place signs to organize activities for rudimentary vehicles, motorbikes, motorcycles, four-wheeled motorized cargo vehicles, four-wheeled motorized passenger vehicles and passenger and cargo transportation by four-wheeled motorized vehicles on the routes assigned for management at the request of the People's Committees of districts, cities and towns.

The police preside over and coordinate with departments, branches, district, city, town People's Committees and relevant units to inspect the compliance with the law on ensuring security, order and traffic safety of agencies, organizations and individuals using four-wheeled motorized cargo vehicles, four-wheeled motorized passenger vehicles, rudimentary vehicles, motorbikes and motorcycles to do business in transporting passengers and goods according to the provisions of law.

At the same time, direct the police of units and localities to strengthen patrols, control, and strictly handle organizations and individuals using rudimentary vehicles, four-wheeled motorized cargo vehicles, and four-wheeled motorized passenger vehicles that violate regulations, causing disorder and insecurity in traffic safety in the management area. Propose relevant agencies to place signs prohibiting and restricting the operation of rudimentary vehicles, motorbikes, four-wheeled motorized cargo vehicles, and four-wheeled motorized passenger vehicles in the management area to ensure smooth and safe traffic...

Decision 36/2025/QD-UBND takes effect from June 10, 2025 and replaces Decision No. 106/2010/QD-UBND dated December 16, 2010 of the Provincial People's Committee regulating the use of rudimentary vehicles, motorbikes, two-wheeled motorbikes, three-wheeled motorbikes and similar vehicles to transport passengers and goods in the province. In case the documents referred to in this Decision are amended, supplemented or replaced, the provisions of such amended, supplemented or replaced documents shall apply.
