Nghe An: Provincial civil judgment enforcement forces to dismantle fence to divide land among brothers in a family
The Nghe An Province Civil Judgment Enforcement Department has just organized the compulsory demolition of assets on land to transfer the Land Use Rights to the person subject to the enforcement - a member of a family in Vinh Hung Ward (formerly Nghi Lien Commune, Vinh City).
This morning (July 24), at plot number 175, map number 41, Hong Lien hamlet, Vinh Hung ward, Nghe An province's Civil Judgment Enforcement Department organized the enforcement and dismantling of assets on the land of Mr. Nguyen Phu Truong and Ms. Nguyen Thi Nham (the judgment debtors), to hand over to the judgment debtors, Mr. Nguyen Phu Huong (residing in Binh Duong province) and Ms. Nguyen Thi Lan (both residing in Vinh Hung ward, Nghe An).

Previously, in April 2024, Nghe An Provincial People's Court issued a Civil Judgment at first instance, partially accepting Ms. Nguyen Thi Lan's lawsuit request to cancel the re-issued Land Use Right Certificate with code CU 334749, dated January 16, 2022, issued by Vinh City People's Committee at land plot No. 175, map sheet No. 41, Hamlet 2, Nghi Lien Commune, Vinh City (now Vinh Hung Ward) with an area of 1,321.9m2.2, named after Mr. Nguyen Phu Truong and Mrs. Nguyen Thi Nham. This plot of land is the legacy of Mrs. Le Thi Man (mother of Mr. Truong, Mr. Huong and Mrs. Lan).

Nghe An Provincial People's Court has allocated 200m2 for Ms. Nguyen Thi Lan to use.2Residential land, worth 1.1 billion VND; Mr. Nguyen Phu Huong is allowed to use 100m2land, worth 550 million VND. Divided for Mr. Nguyen Phu Truong and Ms. Nguyen Thi Nham to inherit 360m2residential land worth nearly 2 billion VND and the area left by Mr. Nguyen Phu Cuong (father of Mr. Truong, Mr. Huong, and Ms. Lan). In addition, Mr. Truong and Ms. Nham were also given the right to use a total area of 1,021.9m2.2remaining land of the above plot.

Nghe An Provincial People's Court also ordered Mr. Nguyen Phu Truong and Ms. Nguyen Thi Nham to dismantle the southern and eastern fences corresponding to the dimensions according to the land plot diagram divided for Ms. Nguyen Thi Lan and Mr. Nguyen Phu Huong.

At the location of the enforcement session, although the Enforcement Officer continued to explain the rights and obligations of the parties, actively encouraged and persuaded the person subject to enforcement to voluntarily execute the judgment, Mr. Nguyen Phu Truong and Ms. Nguyen Thi Nham did not accept. Therefore, the authorities were forced to carry out the enforcement according to the proposed plan.

At the enforcement session, the Civil Judgment Enforcement of Nghe An province coordinated with specialized land agencies, relevant sectors and units and local authorities to measure and re-check the boundary markers and boundaries of the land plot to be handed over...

After completing the initial procedures, the Enforcement Council proceeded to dismantle the assets and build fences at each boundary marker location, and at the same time transferred the Land Use Rights to Mr. Nguyen Phu Huong and Ms. Nguyen Thi Lan for use in accordance with the provisions of law.
