According to legal documents presented at the trial, the Nguyen Xuan family church and Mr. Than's house both originated from land used before 1980. After 1980, the Land Law stipulated that land belonged to the entire people and was managed by the state.

In 1996, Mr. Than declared and was granted a land use right certificate in accordance with legal procedures, so the Nguyen Xuan family's lawsuit against the defendant Nguyen Xuan Than to return 100m2 of land at plot number 238 to the family and cancel Mr. Than's land use right certificate has no legal basis. Because Mr. Than inherited the land left by his parents, and was legally granted the right to use 100m2 of land by the state.

The uncle requested to return 100m2 of land, plot No. 238, map sheet No. 6, in hamlet 4, Quynh Thach commune, Quynh Luu district between the Nguyen Xuan clan and Mr. Nguyen Xuan Than.
Within 15 days from the date of judgment, the plaintiff, defendant, and persons with related rights and obligations have the right to appeal to the People's Court of Nghe An province./.
