Receiving money to fix a case, Deputy Chief of the People's Procuracy was prosecuted

The Supreme People's Procuracy has completed the investigation and prosecution of the criminal case of accepting bribes against Mr. Ha Van Hung, former Deputy Chief of the People's Procuracy of Ea Kar district, and transferred the case file of the accused Hung to the People's Court of Dak Lak province for trial.

Mr. Pham Ngoc Tang - Chief of the Ea Kar District Party Committee Office said that the district has not yet received the Supreme People's Procuracy's Notice of Investigation Conclusion against Mr. Hung. "Upon receiving the decision to prosecute the case and prosecute the accused, the district suspended Mr. Hung's Party Committee activities. Previously, at around 9:00 p.m. on May 5, 2016, Nguyen Ngoc Ha (born in 1980, residing in Cu Elang commune, Ea Kar district) used scissors to cut 16 live pepper vines of Mr. Nguyen Quang Coi (born in 1963, residing in the same commune) to sell for spending money. After bringing the cut pepper vines home, Ha cut the vines into 267 pieces and sold them to several households in the district.

The Ea Kar District Police Department concluded that the total number of pepper vines that Ha had stolen from Mr. Coi's house was 3 years old, and the total value of the stolen property was 2.8 million VND. Ha was prosecuted for the crime of "Theft of property" under Article 138 of the Penal Code. The victim, Mr. Coi, has received the compensation money and has no further requests.

On May 3, 2017, the Ea Kar District People's Court brought the case to trial and sentenced Ha to 7 months in prison for the above act. After the trial, Mr. Ha Van Hung told Ha to give Mr. Hung the money to "reduce the sentence" in the first instance trial, and to "take care" of the appeal. At noon on May 4, 2017, Ha brought 10 million VND to Mr. Hung's house. During the "transaction" at Mr. Hung's house, Mr. Ha recorded it. On the afternoon of May 4, 2017, Mr. Ha filed a direct complaint to the Dak Lak Provincial Police about the act of demanding bribes from the Deputy Chief of the Ea Kar District People's Procuracy.

The content of the clip shows that Mr. Hung said that because he was angry with the lawyer's defense attitude, the panel of judges increased the sentence, otherwise, Ha would only be sentenced to 6 months in prison. In addition, when giving the money, Mr. Ha said to check the amount, but Mr. Hung quickly hid it and replied: No need to check because it's with his brothers.

Previously, also at the prosecution agency in Ea Kar district, the Supreme People's Procuracy's investigation agency approved the prosecution of the case and the prosecution of the accused Truong Thi Hoa (Judge, Deputy Chief Justice of the Ea Kar District People's Court) for accepting a bribe of 80 million VND to "fix the case" for the accused Nong Van Thut, who caused a traffic accident that killed one person. Ms. Hoa was sentenced to only 1 year in prison by the Dak Lak Provincial People's Court.
