Increasing pensions and allowances by more than 7% for a wide range of subjects; Increasing fines for many traffic violations; New regulations on working conditions for general education teachers... are policies that will take effect from August 2017.

Increased fines for many traffic violations

From August 1, Decree 46/2016/ND-CP regulating administrative sanctions for violations in the field of road and railway traffic will take effect.

Accordingly, traffic participants who do not comply with traffic lights (run red lights) will be fined from 300,000 VND to 400,000 VND. An increase of 200,000 VND compared to the old fine; In addition, their motorbike driving license will be revoked for 1 to 3 months;

From August 1, Decree 46/2016/ND-CP regulating administrative sanctions for violations in the field of road and railway traffic will take effect.

Driving in the wrong lane or on the sidewalk (except when driving into a house) will be fined from 300,000 VND to 400,000 VND. An increase of 100,000 VND compared to the old fine;

Not wearing a helmet or wearing it incorrectly will be fined from 150,000 VND to 250,000 VND (increased fine to 50,000 VND)

Using a phone or headset while driving is subject to a fine of 150,000 VND to 250,000 VND; (increased fine to 50,000 VND)

Driving a vehicle while consuming alcohol or beer. Testing for alcohol concentration in the body exceeding the permitted level is subject to a fine of VND 1,000,000 to VND 6,000,000;

Driving in a tunnel without turning on low beam lights (not headlights) will be fined from 500,000 VND to 1,000,000 VND.

In particular, if a driver's license is revoked and the driver continues to drive, he/she will be fined from 800,000 to 1,200,000 VND and have the vehicle impounded for 7 days for vehicles with a cylinder capacity of less than 175 cm3; for vehicles with a cylinder capacity of over 175 cm3, the fine will be from 4,000,000 to 6,000,000 VND and the vehicle impounded for 7 days.

New regulations on working regime for general teachers

Circular 15/2017/TT-BGDDT amends and supplements the Regulations on working regime for general education teachers attached to Circular 28/2009/TT-BGDDT, effective from August 1, 2017.

Accordingly, teachers' annual summer vacation is 02 months including annual leave according to the provisions of the Labor Code, with full salary and allowances (if any).

Regulations on annual teaching hours for principals and vice principals (Circular 28 stipulates weekly hours):

For principals: 2 periods/week x number of weeks for teaching and educational activities according to regulations on the school year schedule;

For vice principal: 4 periods/week x number of weeks for teaching and educational activities according to regulations on the school year schedule.

Principals and vice principals are not allowed to convert the reduced teaching hour quota for concurrent positions to replace the annual teaching hour quota.

In addition, Circular 15 also adds regulations on working regime for teachers of pre-university schools. Accordingly, the working time of pre-university teachers is 42 weeks (similar to primary school teachers, secondary school teachers and high school teachers).

In addition, teachers at preparatory colleges are also subject to the following reduction in teaching hours: Homeroom teachers at preparatory colleges are reduced by 3 hours per week; Female teachers at preparatory colleges with children under 12 months are reduced by 3 hours per week; Deputy Head of Department is reduced by 1 hour per week.

Increase pensions and subsidies by more than 7% for a series of subjects

According to Decree 76/2017/ND-CP adjusting pensions, social insurance benefits and monthly allowances recently issued by the Government, from July 1, 2017, an additional 7.44% will be added to the pensions, social insurance benefits and monthly allowances of June 2017 for 8 subjects.

Specifically includes:

- Cadres, civil servants, workers, public employees and laborers (including those who have participated in voluntary social insurance, retirees from the Nghe An farmers' social insurance fund transferred according to Decision 41/2009/QD-TTg dated March 16, 2009 of the Prime Minister); soldiers, people's police and people working in key positions who are receiving monthly pensions.

- Commune, ward and town officials as prescribed in Decree No. 92/2009/ND-CP dated October 22, 2009, Decree No. 121/2003/ND-CP dated October 21, 2003 and Decree No. 09/1998/ND-CP dated January 23, 1998 of the Government are receiving monthly pensions and allowances.

- People receiving monthly allowances for loss of working capacity according to the provisions of law; people receiving monthly allowances according to Decision No. 91/2000/QD-TTg dated August 4, 2000, Decision No. 613/QD-TTg dated May 6, 2010 of the Prime Minister; rubber workers receiving monthly allowances.

- Commune, ward and town officials are receiving monthly allowances according to Decision No. 130/CP dated June 20, 1975 of the Government Council and Decision No. 111-HDBT dated October 13, 1981 of the Council of Ministers.

- Military personnel receiving monthly allowances according to Decision No. 142/2008/QD-TTg dated October 27, 2008, Decision No. 38/2010/QD-TTg dated May 6, 2010 of the Prime Minister.

- People's police are receiving monthly allowances according to Decision No. 53/2010/QD-TTg dated August 20, 2010 of the Prime Minister.

- Military personnel, people's police, and people working in secretarial work receive salaries similar to those of military personnel and people's police who are receiving monthly allowances according to Decision No. 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister.

- People receiving monthly occupational accident and disease benefits.

This Decree takes effect from August 15, 2017. The regimes prescribed in this Decree shall be implemented from July 1, 2017.

Hazardous waste assessment fee

From August 1, the collection rate, collection, payment, management and use of fees for appraisal and issuance of hazardous waste treatment licenses will be implemented according to the provisions of Circular 59/2017 issued by the Ministry of Finance.

Accordingly, the General Department of Environment (Ministry of Natural Resources and Environment) organizes the collection of appraisal fees according to regulations. The appraisal fee for granting, re-granting, and adjusting hazardous waste treatment licenses is regulated according to each geographical area - where the hazardous waste treatment plant of the organization or individual requesting the license is located.

The fee payer shall pay the appraisal fee within 10 working days from the date of receipt of the written approval of the trial operation from the licensing authority.

Fees are paid directly to the fee collection organization or paid into the fee account awaiting payment to the budget of the fee collection organization opened at the State Treasury.

Raise deposit insurance limit to 75 million VND

From August 5, Decision 21/2017/QD-TTg of the Prime Minister promulgating regulations on insurance payment limits will take effect.

Accordingly, the insurance amount paid for all insured deposits of an individual at an organization participating in deposit insurance is adjusted to increase to 75 million VND (current regulation in Decree 109/2005/ND-CP is 50 million VND). This payment limit includes both principal and interest.

Thus, if a credit institution becomes insolvent or bankrupt, depositors will receive a maximum insurance amount of 75 million VND.

5 forms of budget disclosure for state budget estimate units

Circular 61/2017/TT-BTC guiding on budget disclosure for budget estimate units takes effect from August 1, 2017.

Accordingly, the disclosure of budget estimates, budget implementation status, and budget settlement for budget estimate units is carried out in one or several of the following forms:

Announce at meetings, post at the headquarters of agencies, organizations, and units; Issue publications; Notify in writing to relevant agencies, organizations, units, and individuals; Announce on mass media; Post on electronic information pages (for units with an electronic information portal, they must publicly disclose the budget via their electronic information portal).

Circular 61/2017/TT-BTC abolishes Circular 21/2005/TT-BTC and applies from the 2017 budget year.
